Administrator, heating, pets, websites: new rules are arriving for Italian condominiums. After the yes of the Chamber arrived last Thursday, Parliament is tightening the time on the reform of the discipline of the civil code which regulates the life of 30 million Italians. The bill has landed in the Senate Justice Committee, which will operate in a deliberative session. This means that the commission itself will be able to approve the text definitively, without going through the Chamber. The green light could therefore arrive very soon. Once the passage to the Senate has been passed, six months will still have to pass for the rules to come into force. Let's see what the fundamental points of the reform are.
REVOCABLE ADMINISTRATOR
The administrator may be fired before the end of the mandate (which lasts two years) in the event that he has committed serious tax irregularities or has not opened or used the condominium current account. If the condominium assembly refuses to revoke the mandate, the individual condominium can appeal to the judge and have the expenses reimbursed by the condominium. The same judge may dismiss the administrator who has not prepared the report or has not disclosed a summons to the condominiums.
PETS
The condominium regulations will no longer be able to prohibit the possession or presence of dogs and cats.
HEATING, EASIER TO LEAVE THE CENTRALIZED SYSTEM
Anyone who wants to make himself independent of central heating can do so even without the approval of the assembly, provided he does not harm others and continues to pay for the extraordinary maintenance of the condominium system.
LOWER DELIBERATIVE QUORUMS
The quorum in the meeting then decreases, i.e. the quorum necessary to make the meetings and their resolutions valid, which must be equal to the majority of those attending the meeting, representing at least half of the thousandths.
CONDOMINIUM INTERNET SITE
The same quorum will also be needed to activate, by the administrator and at the expense of the condominiums, a condominium website, with individual access protected by a password, to consult and print the monthly reports and other documents of the assembly in digital format .
INTENDED USE OF COMMON LOCALS
To change the intended use of the common areas, four fifths of the consents will suffice.
FINES FOR VIOLATIONS
The fines for those who violate the regulation are tightened: 200 euros, which can rise to 800 in cases of recidivism.
