Smart working, twist: extension to 30 June 2023 for frail people and parents of minors under 14

Twist in the Senate: here comes the extension with the smart working for fragile workers (both in the sector private in that public) and for i Parents with children under the age of 14 (only in private) until 30 June 2023. For parents with children under 14, the right to request (and obtain) smart working expired in December, while for the frail the current legislation expires on 31 March. An amendment to the Milleproroghe decree arrives in extremis which extends the possibility of agile work until June - for these categories - even "in the absence of individual agreements" but "provided that this method is compatible with the characteristics of the service". This is foreseen by an amendment to the Milleproroghe presented by the Pd, presented by Antonio Nicita, and approved unanimously in the Budget and Constitutional Affairs commissions of the Senate.

The 2023 Budget Law had extended smart working for fragile workers until 31 March. Up until a few hours ago it seemed that the extension would have to be canceled entirely due to coverage problems, but in the end the rapporteurs found the right balance and granted three more months.

Who are the fragile workers?

But who are the fragile workers? “Public and private employees affected by the pathologies and conditions identified by the decree of Minister of Health referred toarticle 17, paragraph 2, of the decree-law 221/2021″. These are those subjects "with marked impairment of the immune response".

For example, i patients who have undergone “solid organ transplant under immunosuppressive therapy”, “haematopoietic stem cell transplant” and who are currently “pending organ transplant”. But also those patients with "oncological or onco-haematological pathology in treatment with immunosuppressive or myelosuppressive drugs or less than six months after the suspension of treatment" and "acquired immunodeficiency syndrome (AIDS)".

Furthermore, the decree also mentions those patients who have three or more pathologies including ischemic heart disease, atrial fibrillation, heart failure, stroke, diabetes mellitus, chronic obstructive pulmonary disease, chronic hepatitis and obesity.

Smart working, extension also in the Public Administration

Green light to extension until 30 June of the measure that allows the fragile - in the public - to be able to access smart working despite having tasks that are not compatible with smart working, and which must therefore be replaced: such as teachers, or nurses. The Government has found, on the woolen thread, 16 million euros to finance the extension of agile work also for fragile workers in the public sector.
