A new chapter opens in the legal drama of ChatGpt: Privacy Guarantor has officially notified a Open AI thenotice of dispute for the alleged violation of the regulations on the protection of personal data. The company now has 30 days to provide its defense. The legal battle of the Privacy Guarantor to safeguard the privacy of Italian users who use the widespread artificial intelligence chatbot continues with accusations, defenses, changes to the processing of personal data and reactivations.

ChatGpt, violation of privacy: what happened?

At the end of March, the Italian Privacy Guarantor had highlighted serious privacy risks of users who used the Open AI platform. After the opening of a detailed investigation, the Authority immediately imposed a temporary limitation on the processing of Italian users' data, resulting in the blocking of ChatGpt in our country and the temporary block of the platform by Open AI. The block, which lasted for a month, was lifted at the end of April, when ChatGpt was reactivated after changes to the company's policies and a agreement with the Guarantor, at least on some critical aspects. The investigation continued its course, culminating today, 29 January, with the presentation of the results by the Guarantor according to which "the elements acquired may constitute one or more offenses with respect to what is established by the EU Regulation". Now, Open AI has a month to respond, revealing its defenses in this complicated legal game. In the meantime, a special committee bringing together data protection authorities from across the European Union has been established, and our Authority will take the work of this task force into account. At the end of the proceedings, Open AI may be subject to a sanction equal to 2-4% of its turnover, which it would represent tens of millions of dollars.
