Labor decree today in the Senate Chamber: 20% node on fixed-term contracts

The labor reform game is in full swing. The examination in the Senate committee concluded yesterday evening with the approval of the amendments presented by the Government. These are eight amendment proposals to the Poletti decree which contain the innovations on which the majority (Pd, Ncd and Sc) signed an agreement last week at Palazzo Madama. 

Today at 15 pm the discussion in the Chamber will begin, where a further 701 amendments have been presented, which could push the Executive to place their trust, given the shortage of time. The text, in fact, will then pass to the Chamber for definitive approval, which must arrive by May 19, under penalty of forfeiture of the measure.

FORWARD CONTRACTS AND THE 20% KNOB

In the latest version of the decree, the stabilization obligation for companies that exceed the ceiling of 20% of fixed-term contracts has been transformed into a fine of between 20 and 50% of the salary. 

The contracts with which the company exceeds the 20% limit will in any case remain valid until expiry and it will always be possible to renew them. Limits other than the 20% will be allowed if provided for in the collective agreements applicable to the company.

Furthermore, the 20% ceiling will not be in force for temporary contracts stipulated between research institutions (public and private) and "workers called upon to carry out exclusively scientific or technological research activities, technical assistance or coordination and direction thereof". 

Fixed-term contracts that have the "exclusive" object of carrying out scientific research activities may exceed the maximum limit of 36 months, so as to link the duration of the contract to that of the research project.

APPRENTICESHIP

The return of the compulsory stabilization quota of apprentices (20%) is limited only to companies with over 50 employees (at first there was talk of 30). Confirmed the restoration of the apprenticeship also on a fixed-term basis for carrying out seasonal activities.

PROFESSIONAL INSTITUTIONS

An amendment by the Movimento 5 Stelle was also approved in the commission, which provides for "particular attention" to professional institutes, in order to favor the path of integration in the context of school-work alternation.
