The doors of voluntary disclosure are already reopened. The questions, reminds the Agenzia delle Entrate, can be sent until 31 July 2017. Those who intend to send an application for access to the new procedure as of today can use the old form approved by the Agency on 30 January 2015 and send it for electronically.

From this year, however, there is a big change. The voluntary disclosure, i.e. the procedure for regularizing assets and financial assets not declared to the tax authorities, may also concern cash or bearer valuables deposited in the safety deposit box.

However, strengthened rules are envisaged against hypothetical crimes, such as the presence of a notary for the inventory and a double declaration on the non-illegal origin of the money.

DISCLOSURE UNTIL SEPTEMBER 30, 2016

The procedure allows you to comply with the tax authorities for violations up to 30 September. You also avoid being prosecuted for tax crimes and self-laundering. However, the taxes and contributions due must be paid in full.

APPLICATION UNTIL JULY 31, THEN INTEGRATION

It will be possible to join provided that the application has not already been presented in the past, even through a third party and up to 31 July 2017. It is possible to integrate the application with documents and information up to 30 September next.

THE SANCTIONS

The mechanism of sanctions is complex and varies according to the types of finance remedied, from the property in a black-listed country to a deposit in Switzerland. The general logic is that you pay the taxes you should have paid. For example, on money held in a foreign bank account, one would pay 0,5% for omitted declaration and 27% annual taxation on the yield: in practice, an account worth 1 million, assuming a yield of 5% and therefore a gain of 50.000 euros, he will pay 27,5% of this sum, i.e. 13.500 euros.

YOU PAY IN SELF-TAXATION

For the voluntary bis, a self-assessment mechanism is envisaged, with penalties for those who pay less or fail to pay what is due. This is the real news. It will be possible to pay in a single solution by 30 September 2017, or to divide the amount into three equal monthly installments. Penalties of 3% or 10% are envisaged for those who make errors, if the thresholds of 10% for formal errors and 30% for others are exceeded. For those who mistakenly pay more than the amount due, the possibility of using the excess as a refund or of using it for compensations is triggered.

CASH IN SAFETY BOXES

Cash and bearer valuables contained in safety deposit boxes can be included in the voluntary but with a specific procedure. The opening of the box and the inventory must be done in the presence of a notary and the taxpayer must issue a declaration certifying that the values ​​do not derive from crimes. Finally, the amounts must be paid, with the obligation for professionals who assist taxpayers and for intermediaries to report the amounts for the purpose of preventing money laundering and terrorist financing. For this, a further statement on how to acquire the cash will be needed. Those who make false declarations risk between 18 months and 6 years in prison.

COMMON LIGHTHOUSE ON THOSE MOVING ABROAD

Taxpayers who move abroad and register in the register of Italians residing abroad will be included in selective lists of tax controls.
