Among the many new features coming with the tax reform, the hypothesis of a two-year preventive agreement between the Revenue Agency and taxpayers. A sort of pact that would block taxes for two years for SMEs and VAT numbers and, in the intentions of the Ministry of Finance, should rewrite the rules for the fight against tax evasion in a preventive and no longer punitive sense.
An instrument strongly desired by the Deputy Minister of the Economy, Maurice Leo, which in the tax reform – expected to be examined in the second reading in the Senate – moves in the phase preceding the controls and allows taxpayers with business income and smaller self-employment to accept and comply with a proposal formulated by the tax authorities on basis of the information contained in its databases. But how does it work?
How does the new two-year arrangement with creditors work?
The Revenue Agency will propose the new two-year arrangement based on the data it has available on the taxpayer's economic activity. In detail, the taxman analyzes the data arriving from electronic invoicing and by electronic receipts, and on the basis of these it would be able to estimate the subject's income and establish a tax base, which will be subject to taxation. This taxable base for income tax and Irap purposes will be "frozen" for two years and the taxpayer will be required to pay the same amount of taxes even in cases where income undergoes changes, increases or decreases. However, it would not includeVAT, which would therefore continue to be paid on the basis of the operations actually carried out. In simple words, if the taxpayer accepts the hypothesized value, he will not have to pay any other tax – with the exception of VAT – on any excess. Attention, they are not completely excluded subsequent checks which can also lead to decadence, should the subject alter the declarations by inserting untruthful elements.
Furthermore, taxpayers would not be obliged to accept the arrangement. The company or the professional can decide independently. Obviously it is convenient if you expect to increase your turnover in the following two years, as you will be sure that your taxable income will not increase. On the contrary, it will not be convenient if a decrease is expected.
2,5 million VAT numbers involved
It's about tracking and chasing at least 2,5 million VAT numbers, now subject to tax report cards, and beyond 6.200 companies. These are the orders of magnitude on which the government, first and foremost the Deputy Minister of the Economy, will move the new instrument, once the new fiscal delegation bill has been approved by the Senate. The government's intention is to gradually exceed il report card system which are technically called Isa (summary indicators of fiscal reliability) and which since 2018 have taken the place of sector studies.
Sogei-Sose arm in arm to favor the new arrangement with creditors
The preparatory work on the arrangement with creditors will soon be able to count on one super database of the taxman. The Ministry of the Economy is in fact finalizing the merger project between Sogei (Mef's technological partner) e Never (the company owned by Mef and Banca d'Italia which first managed the sector studies and now the tax report cards). Having already available the information from Sose and those from the Tax Registry, the intention is to take a step further and use theartificial intelligence, for which we are already equipping ourselves, also in predictive terms.
However, the new arrangement with creditors, in addition to artificial intelligence, could continue to use the scoring system. The orientation is that of the current reward system: whoever, in fact, reaches a vote from 8 upwards, thus adapting to the result expected by the tax authorities' indicators, will be able to have a preferential lane for accessing the composition. A hypothesis that could concern, according to the data on the latest declarations available, almost 1,1 million. Just under half of the audience: this means that it will be necessary to work on the remainder (about 55%) to ensure that the change of perspective really works and does not turn out to be, as many criticize, a gift to dishonest taxpayers.
