Three more weeks to request the scrapping of the Equitalia folders issued until 2016. The extension of the deadline for submitting the application from March 31st to April 21st is foreseen by a majority amendment to the Earthquake law decree: if the modification proposal passes the scrutiny of admissibility, will have the road paved, because the Deputy Minister for the Economy Luigi Casero has already announced the government's favorable opinion.

Meanwhile, more and more Italians are asking for the scrapping of the Equitalia folders. As of February 28, the collection agency had registered 343.340 claims, an acceleration of 246% in the last two months. In Rome, 37.419 applications have already been presented, while the second city in the standings is Milan with 21.927 applications. In third place Naples at an altitude of 17.636.

But how does the scrapping of Equitalia folders work? Here is a brief guide from the Revenue Agency on.

1) WHICH DEBTS CAN I SCRATCH?

Debtors whose charges have been entrusted to the Collection Agents from 2000 to 2016 can submit a request for the scrapping of the files. This includes Equitalia files not notified to the debtor by 31 December, but of whose existence the Collection Agent has notified the debtor by ordinary mail. Sums on which a dispute is open can also be scrapped, but with the request for scrapping the taxpayer undertakes to waive the judgments relating to the loads that he intends to scrap.

2) WHAT ARE THE ADVANTAGES OF SCRAPPING?

The scrapping of the Equitalia folders allows you not to pay fines and default interest.

3) WHAT SHOULD I PAY WITH THE SCRAPPING?

Taxpayers can choose the debts for which they want to take advantage of the scrapping of Equitalia files: there is no obligation from this point of view. However, for each file to be scrapped, it will be necessary to pay the principal, interest, expenses incurred for credit recovery procedures and the premium due to collection agents.

4) HOW MANY ARE THE INSTALLMENTS? WHEN ARE THEY PAID?

The installments envisaged for the scrapping of the Equitalia folders increased from 4 to 5: three in 2017 and two in 2018. 70% of the sums due must be paid in 2017 and the remaining 30% in 2018. For 2017 the installments deadline is fixed in the months of July, September and November and for 2018 in the months of April and September.

5) WHAT HAPPENS TO THOSE WHO DON'T PAY AND TO LATE PEOPLE?

If after initiating the procedure the taxpayer does not pay in full or pays late the sums to be paid in a single solution or one of the installments, the scrapping loses its effectiveness and the procedure is not successful. In these cases and any payments already made are acquired as a down payment. Furthermore, the statute of limitations and forfeiture terms resume and the collection activity continues, with no possibility of rescheduling the payment of the debt, except in the case in which the first installment has not been paid promptly and in full.
