Naspi 2015: calculation, requirements and duration. This is how the new unemployment benefit works

On May XNUMX, Naspi comes into force, the unemployment benefit that replaces the previous Aspi and Mini-Aspi. With the introduction of Naspi, the Jobs Act also extended financial support to seasonal and precarious workers in the event of involuntary unemployment. From May 2015, XNUMX comes into force Naspi, the new unemployment benefit. Inserted by the Renzi government in the Jobs Act, Naspi, starting from 2015, will replace the previous forms of unemployment support Aspi, and mini-Aspi.

With the legislative decree of 4 March 2015, with provisions for the reorganization of the legislation on social safety nets in the event of involuntary unemployment, Naspi is regulated for 2015. The New Employment Social Insurance benefit, created to guarantee support in the event of involuntary unemployment even to precarious and seasonal workers, has particular characteristics. The methods for calculating the indemnity, the requirements for the recipients and the duration of the 2015 Naspi are explained below.  

The requirements to apply

Naspi recipients are employees who have involuntarily lost their jobs. In addition, to apply for Naspi, workers must meet the following requirements:

– are unemployed,

– can claim, in the four years preceding the beginning of the period of unemployment, at least thirteen weeks of contributions;

 - and finally, thirty days of effective work, regardless of the minimum contribution, in the previous twelve months.

The Naspi allowance also affects workers who have resigned resignation for just cause and in cases of consensual termination of the employment relationship. The Legislative decree of 4 March he specifies that permanent workers are excluded from the public administration and agricultural workers on fixed-term and permanent contracts. And finally, he informs that the disbursement of the Naspi is subject to the active search by the unemployed for a new job or to participation in professional retraining courses.

How to calculate the Naspi

The Naspi is calculated on the basis of the taxable salary for social security purposes of the four years preceding unemployment divided by the number of weeks of contributions and finally multiplied by the coefficient 4,33.

La Naspi will be supplied in two different sizes:

– in the event that the recipient's monthly salary is equal to or lower than the amount of 1.195 euros, the indemnity will be equal to 75% of the monthly salary;

– in the event that the monthly salary is higher than the fixed ceiling, the indemnity will be equal to 75% of the salary plus 25% of the difference between the monthly salary and 1.195 euros.

In any case, the maximum limit for the monthly Naspi allowance for 2015 has been set at 1.300 euros. Finally, the March 2015 decree provides that the Naspi indemnity is reduced by 3% per month starting from the first day of the fourth month of use.

Duration

Unemployment benefit is paid on a monthly basis for one maximum of two years. The duration of the Naspi is calculated as half of the weeks of contributions accrued in the last four years. This calculation does not consider the periods of work and contributions thanks to which the worker has already used Aspi and mini-Aspi. Starting from 2017 January 78, Naspi will be provided for a maximum of XNUMX weeks.

Question and Compatibility

Workers interested in the Naspi allowance must submit an online application to INPS within 68 days of the end of the employment relationship. The unemployed person who receives Naspi loses the right to it if he finds a new subordinate job with an annual income higher than the minimum income. In the event that the income of the new job is lower than the minimum income, the worker retains the right to Naspi provided that he communicates the new occupation to INPS.

Furthermore, the worker can request the payment of the entire Naspi in advance and in a single solution as an incentive for starting a new business or self-employment activity.

After Naspi comes Asdi

Il Jobs act also introduced Asdi an unemployment benefit introduced on an experimental basis for next year. Workers who on 31 December 2015 will have finished the Naspi indemnity period, still without work and in particular conditions of need, will be able to take advantage of Asdi. The duration of the indemnity, calculated on the 75% of the last Naspi checkwill be six months. The disbursement of Asdi is also subject to participation in active job search policies.

Seasonal workers

Following controversies and doubts related to seasonal workers as recipients of Naspi, a clarification comes from the Ministry of Labour.

In practice, periods without contributions from the employer or zero-hour layoffs are considered "neutral and will lead to an extension, equal to their duration, of the four-year period within which to seek the necessary requirement of at least thirteen weeks of contributions”. The same neutral value principle also applies to the requirement of 30 days of actual work in the last 12 months. The Ministry concludes by informing that all the controversial aspects will be clarified in the Naspi implementing circular which will be issued shortly by INPS.
