New rules for the reads 104 governing i permits paid pursuant to Law 104. On the basis of what will be established eliminated the figure of the sole contact person, i.e. the subject who until now was the owner of the economic and work benefits. How will it work?
Law 104, new rules: via the sole contact person
The new rules introduced by the legislative decree n. 105 of 30 June 2022, which entered into force on 13 August, were communicated by INPS through the message 3096.
The legislative decree implements directive (EU) 2019/1158 of 20 June 2019 and establishes that it is possible for more than one employee take advantage of the days of paid leave to assist a person with a serious disability. Therefore the figure of the single referent disappears: more people they will be able to have access to 3 days of leave per month or equivalent hours of leave.
Law 104: here's what changes
In addition to the possibility for more subjects to use the usual permits, another novelty came into force in 2022. With the circular no. 36 of 7 March 2022, the INPS had extended the possibility of requesting paid leave to a series of subjects, in particular the de facto couples and civil unions between persons of the same sex, fully equal to spouses.
The use of permits and extraordinary leave is subject to request for authorization from INPS and cannot simply be communicated to the employer. The hours of leave must be used only in the interest of the disabled person, not for personal reasons. Failure to comply with these rules could result in dismissal.
