The Government has published the faqs on the April 26 decree, while the Interior Ministry has issued a special circular: who are the relatives? When and how can you move from one Region to another? The rules for sports and walks? And how to get organized with work? Here are all the answers

Relatives, walks, off-site: the Government FAQs on Phase 2

The Government has finally published clarifications on the rules in force since 4 May, the day on which phase 2 of the coronavirus emergency officially starts. Indeed, the decree of 26 April brought about important innovations on travel and at work, allowing the reopening of some production activities and businesses. The new rules have been summarized as follows in the FAQs on the Palazzo Chigi website: 

Starting from 26 May, the Prime Ministerial Decree of 2020 April 4 introduces various innovations, including, for example, the possibility of visits to relatives who live in the same region and the reopening of public parks and gardens, in compliance with health and safety requirements. avoiding gatherings in any case (the mayors may decide to close the parks again and temporarily, if the ban on gatherings cannot be guaranteed).

The use of the mask in closed places accessible to the public (such as public transport and shops) becomes mandatory.

The new Dpcm also establishes the obligation to remain indoors for all those with symptoms related to respiratory syndromes and a body temperature above 37,5 degrees.

Also from 4 May, it is possible to return to motor and sporting activity, individually, even far from home.

Another important novelty concerns the possibility of carrying out funeral celebrations, with a maximum number of participants set at 15 people, wearing protective masks and possibly outdoors.

The Dpcm, also starting from 4 May, allows take-away catering for bars, restaurants and the like, which is added to the already admitted home delivery activity.

Various production and industrial activities restart, activities for the manufacturing and construction sectors, together with all the wholesale activities related to them, with the obligation to comply with the rules in force on safety at work.

These rules will remain in effect until May 17, the day in which the Executive could decide to further ease the restrictions. For the moment, the road map set by Palazzo Chigi provides that retail shops and museums will reopen their doors on May 18, while team training will be able to resume on the same date. However, if the contagion curve does not reserve nasty surprises, it is possible that in the next two weeks the Government decides to approve differentiated openings for the various Regions, with greater concessions in the territories where the contagion seems to have returned under control.

For the moment though, date X remains that of May 4th. In case there was still doubt about the possibility of going to the second house, the Government specified that "it is not a necessity" and therefore cannot be done. The answer is not contained in the Faq, although it is one of the most popular questions in recent days. For the rest: from the now famous "relatives" to sports and outdoor walks, from off-site trips to construction sites, from agriculture to production and commercial activities, here are the government's FAQs that allow you to understand how to adjust from Monday. 

JOINTS

The catchphrase on relatives it may have come to an end. Since April 26, the day on which the Government published the last Dpcm, citizens have wondered who these "relatives" were. The question assumed such unexpected proportions as to push the Government to provide an initial clarification as early as 27 April. With the faq published on May 2nd, the final details on who we can visit from May 4th arrive. So let's repeat it one last time: who are the relatives?

The context to which the term "joints" may refer can indirectly be derived, systematically, from the rules on kinship and affinity, as well as from the jurisprudence on the subject of civil liability.

In the light of these references, it must be considered that the "relatives" to which the DPCM refers include: spouses, cohabiting partners, partners in civil unions, people who are linked by a stable emotional bond, as well as relatives up to the sixth degree (such as, for example, children of cousins) and relatives by marriage up to the fourth degree (such as, for example, cousins ​​of the spouse).

The Ministry of the Interior also intervened on the joint term, which in a circular cites a sentence of the Cassation and specifies that it refers to

“relationships characterized by lasting and significant sharing of life and affections”.

Friends, for the Government, do not fall within the category of relatives. Meetings with the latter are considered "journeys justified by necessity", but it will always be necessary to respect the rules by applying the distance and using the masks.

WALKS AND SPORTS

Loosen the stringent rules in force until May 3 on walks and outdoor sports. At first, the Government clarified:

Walks are allowed only if strictly necessary to make a journey justified by one of the reasons just indicated. For example, it is justified by reasons of necessity to travel to do the shopping, to buy newspapers, to go to the pharmacy, or in any case to buy goods necessary for daily life, or to go to any of the open shops. Furthermore, every exit from the home for outdoor sports or motor activity is justified. It is understood that the justification for all permitted movements, in the event of any checks, can be provided in the forms and with the permitted methods. The justification of the reason for work can also be proven by exhibiting adequate documentation provided by the employer (cards or similar) capable of demonstrating the declared condition. In any case, all movements are subject to the general ban on gatherings, and therefore to the obligation to respect the minimum safety distance of one meter between people.

On sports and motor activity instead:

Outdoor sports and motor activity is only allowed if it is carried out individually, unless it is people living together. Starting from 4 May, outdoor sports and motor activity will no longer be allowed only in the vicinity of one's home. It will be possible the presence of a companion for minors or for people who are not completely self-sufficient.

It is mandatory to respect the interpersonal distance of at least two meters, if it is a sporting activity, and one meter, if it is a simple motor activity. In any case, gatherings are prohibited.

In order to carry out the motor or sports activity referred to above, it is also permitted to travel by public or private transport to reach the place identified for carrying out these activities. It is not allowed to carry out motor or sporting activities outside one's own Region.

Ok to use the bicycle to go to work, go home or go to a shop. You can also use the bike for sports. Mandatory to respect the safety distances. Finally, access to parks, villas and public gardens will be allowed, as will visiting cemeteries for the deceased.

As far as athletes are concerned, the Ministry of the Interior, through a circular, specifies that:

In any case, it is believed that even professional and non-professional athletes of non-individual disciplines, like every citizen, can practice individual sporting activities, in public and private areas, in compliance with the interpersonal distance of at least two meters and respecting the prohibition of any form of gathering".

From 4 May, therefore, footballers, volleyball players and all sportsmen and women who play team sports will be able to return to training, even in the club's facilities, provided that the training sessions are carried out individually.

OUTSIDERS CAN GO HOME, BUT WATCH OUT FOR THE RULES

Compared to what was previously established, the dpcm of 26 April allows travel between one Region and another (but also within the same Region) if you return to your home, home or residence. But be careful because even in this case there are rules:

The Dpcm of 26 April 2020 allows the movement between different Regions only in cases where they occur: proven work needs or absolute urgency or health reasons. Therefore, once you have returned to your domicile/home/residence, even if you come from another Region (as permitted as of 4 May 2020), travel outside the borders of the Region in which you are located will no longer be permitted. is located, if one of the legitimate reasons for moving indicated above does not apply.

THE RULES FOR THOSE WHO GO BACK TO WORK

Traders and merchants who will reopen on May 4th will have to respect strict rules:

The rules are indicated in Annex 5 of the Prime Ministerial Decree of 26 April 2020. Among these are the maintenance, in all activities, of social distancing and environmental cleaning and hygiene at least twice a day and depending on the opening hours . It is also mandatory to enforce anti-contagion measures, such as entry one at a time into small shops and regulated and staggered access into larger structures, the use of masks and gloves for workers and that of gel to disinfect hands and disposable gloves for supermarket customers, to be made available near checkouts and payment systems, as well as, where possible, different routes for entry and exit.

Those who are forced to stay closed will be able to take advantage of e-commerce, takeaway and home deliveries.

CONSTRUCTION SITES AND AGRICULTURE

The Government provides some important clarifications on construction sites:

Yes. In this regard, it should be noted that Annex 3 to the Dpcm of 26 April 2020 refers to the "civil engineering" category, identified with the Ateco code 42 which includes, by way of example, the construction of roads, highways and airport runways, construction of railway and underground lines, construction of bridges and tunnels, construction of public utility works for the transport of fluids, construction of public utility works for electricity and telecommunications, construction of hydraulic and the completion of public housing. On 24 April 2020, the Minister of Infrastructure and Transport shared with the Ministry of Labor and Social Policies, Anci, Upi, Anas Spa, RFI, ANCE, Alliance of Cooperatives, Feneal-Uil, Filca-CISL and Fillea-CGIL a specific regulatory protocol for the containment of the spread of COVID-19 on construction sites, constituting Annex 7 to the Dpcm.

With regard to agriculture, the Government specifies: 

Yes, the cultivation of land for agricultural or forestry use and the activity aimed at production for self-consumption fall within the ATECO "0.1." codes. and "02" and are therefore permitted, provided that the interested party certifies, with a self-declaration complete with all the necessary indications for the relative verification, the possession of such productive agricultural or forestry area and that it is actually used for the aforementioned purposes, with indication of the shortest route to reach the site. However, it should be noted that forest cutting can only continue if the competent Autonomous Region or Province has extended the terms for the cutting season with its own deed. The possibility of making use of professionals in compliance with workplace safety regulations remains unaffected, with particular reference to the provisions for the prevention of contagion from COVID-19.

UNIVERSITIES

Exams and graduation sessions they can be carried out in presence, provided that the distance is respected and the reduction of the "risk of proximity and aggregation" is ensured. If this is not possible, remote mode can be used. 

As it regards instead internships, research, experimental laboratories, teaching and exercises

These activities will be able to resume being carried out face-to-face provided that there is an organization of spaces and work such as to minimize the risk of proximity and aggregation and that the organizational prevention and protection measures indicated by the Dpcm of 26 are adopted. April 2020.

In the event that the adoption of these measures cannot be ensured, or in all other cases in which the presence of students and/or researchers is not possible, remote methods may also be used, where possible.
