Cannabis light, the Cassation stop arrives

Stop by the Supreme Court on the sale of derivative products such as oil, leaves, inflorescences and resin in shops. They constitute a crime unless they are devoid of "doping efficacy". Last word to the judge

Cannabis light, the Cassation stop arrives

Stop the Cannabis light but with the discretion of the judge: ultimately he will have the last word. In essence the Supreme Court has raised the red disc on Cannabis light: the law does not allow the sale or transfer for any reason of products “derived from the cultivation of cannabis”, like oil, leaves, inflorescences and resin, they established the joint criminal sections of the Supreme Court which thus give one stop the sale of 'light cannabis'. It should be remembered that the Higher Health Council which had blocked the sale of hemp quality despite the low or irrelevant concentration of Thc, the psychotropic substance present in the other varieties of the plant.

The commercialization of “Cannabis sativa L.” and, in particular, of leaves, inflorescences, oil, resin, obtained from the cultivation of this specific variety of hemp, does not fall within the scope of the law n.242 of 2016 which only qualifies the cultivation of hemp "of the varieties for use for medical purposes as lawful, "Therefore, the Court of Cassation states in its statement on 'light cannabis', "the selling conduct and, in general, the marketing to the public, in any capacity, of products derived from the cultivation of Cannabis sativa L.," constitute a crime.unless such products are concretely devoid of doping efficacy". It will therefore be the judges of the merits, from time to time, who will evaluate the threshold of "doping efficacy" which falls within the 'parameters' of what is permitted. The verdict issued by the United Sections ended with the annulment with postponement of the revocation of a seizure of products derived from cannabis, as requested in the alternative by the Pg of the Supreme Court who had expressed himself for sending the documents to the Consulta, as before indication.

On the Cassation regarding cannabis “I am not surprised by the sentence, I am sorry for the jobs, which I hope can be reconverted. But it is a clear message, it clarifies an obvious thing, drugs hurt and you can have fun in a different way", said the deputy prime minister Matteo Salvini in Dritto e Rovescio on Rete 4 commenting on the sentence against hemp shops, against which the Minister of the Interior had launched a campaign.
