The bears of Trentino are safe: the Council of State accepts the appeal of animal rights activists

The bears of Trentino are safe. The Council of State accepted the appeals of animal rights associations - including Leal, Lav, the National League for the Defense of Dogs and Oipa - suspending the ordinances of Jj4 and Mj5 shot down issued by the president of the Autonomous Province of Trento, Maurizio Fugatti for alleged danger. With the suspension of the killing of the two plantigrades by the State Council, the story now returns to Tar of Trento – which he already had felling suspended – will have to fix a new hearing.

The sentence

According to the judges, "the provision which provides for the slaughter of the animal appears disproportionate and inconsistent with the supranational and national regulations which require the adequate evaluation of intermediate measures, without prejudice to the captivation ordered to protect public safety, the order to kill the animal". The provision also states that "the supranational regulatory framework requires that the measure of killing represents the last resort and that exceptions to the ban on the killing of protected species may be authorized 'provided that there is no other valid solution' and in the only limits deriving from European and international constraints”.

What will happen to the two bears?

Jj4 – the specimen held responsible for the fatal attack on Andrea Papi last April 5 in the Caldes woods is currently confined to the Casteller wildlife centre. But a transfer project is already ready at the Libearty Bear Sanctuary in Zarnesti in Romania. Instead, MY5 – had instead attacked a 39-year-old hiker a month earlier in Val di Sole, wounding him in the arm and in the head – it is still in freedom in the Trentino woods.
