THEInpgi, the pension fund of Italian journalists, will flow into theINPS in just over six months. The "activities for the next step" have entered "the operational phase", the National Insurance Institute said in a note, specifying that "yesterday a meeting of the top management of both institutes, with the president of INPS Pasquale Tridico and the president of Inpgi Marina Macelloni, the general director of Inpgi Mimma Iorio and the central managers of Inps Pensions, Social Shock Absorbers, Revenue, Personnel and Information Technology, have launched the program of alignment of procedures and personnel which will allow a complete incorporation of the journalists' welfare branch INPS professionals starting July 2022, XNUMX".

The "main areas for the exchange of information - continues the note - and a schedule of meetings between the structures have been identified. In particular, management and technical aspects will be addressed as early as next week between all the INPS central departments concerned and the Inpgi offices". All this takes place in the full application of the agreements included in the art. 1, paragraphs 103-118 of Law No. 234 of 30 December 2021, i.e. the 2022 Budget Law.

Here is what the relevant paragraphs provide for, cited by article 1 of the text of the law:

103 - In order to guarantee the protection of social security benefits in favor of journalists, with effect from 1 July 2022, the social security function carried out by the National Insurance Institute for Italian Journalists Giovanni Amendola» (INPGI) pursuant to article 1 of the law 20 December 1951, n. 1564, in replacement of the corresponding forms of compulsory social security, is transferred, limited to the replacement management, to the National Social Security Institute (INPS) which happens in the relative active and passive relationships. With effect from the same date, professional journalists, publicists and trainees holders of an employment relationship of a journalistic nature are registered with the compulsory general insurance for the invalidity, old age and survivors of employees, as well as, with separate accounting evidence , holders of insurance positions and holders of direct pension treatments and survivors already registered with the same form.

- 104. The pension regime of the subjects referred to in paragraph 103 is standardized, in compliance with the pro-rata principle, with that of members of the employee pension fund with effect from 1 July 2022. In particular, for those insured with the replacement management of the INPGI, the amount of the pension is determined by the sum: a) of the pension shares corresponding to the contributions seniority acquired up to 30 June 2022, calculated by applying the provisions in force at the INPGI; b) of the portion of the pension corresponding to the seniority of contributions acquired starting from 1 July 2022, applying the provisions in force in the employee pension fund.

- 105. Without prejudice to the provisions of paragraph 104, to subjects already insured with the INPGI replacement management for which the first contribution credit starts on a date between 1 January 1996 and 31 December 2016, the contribution ceiling referred to in article 2, paragraph 18, second sentence, of the law of 8 August 1995, n. 335. The contribution ceiling mechanism referred to in the aforementioned provision applies to subjects already insured with the INPGI substitute management with the first contribution credit starting after 31 December 2016, for whom the pension treatment is calculated exclusively with the contribution calculation system.

- 106. Without prejudice to the provisions of paragraph 104, for the purposes of the right to pension treatment, persons already insured with the INPGI substitute management who have met the requirements established by the legislation in force at the INPGI by 30 June 2022 at the said date obtain the right to the pension benefit according to the same legislation.

– 107. The committee referred to in article 22 of the law of 9 March 1989, n. 88, is supplemented, with a decree of the Minister of Labor and Social Policies, by a representative of the trade union organization most representative of the category of journalists, limited to meetings and issues concerning the subjects referred to in paragraph 103.

– 108. Starting from 1 July 2022 and until 31 December 2023, unemployment and redundancy payments are recognized to eligible journalists according to the rules established by the regulatory legislation in force at the INPGI as of 30 June 2022 The treatments are provided at the expense of the Management of temporary benefits to employees, pursuant to article 24 of the law of 9 March 1989, n. 88, to which the contribution for the same period pertains. Starting from 1 January 2024, the regulations envisaged for the generality of workers enrolled in the employee pension fund will apply.

– 109. From 1 July 2022 and until 31 December 2023, accident insurance continues to be managed according to the rules established by the regulatory legislation in force at the INPGI on 30 June 2022. Treatments are provided at the expense of the 'National institute for insurance against accidents at work (INAIL), to which the relative contribution pertains. Starting from 1 January 2024, the regulations envisaged for the generality of workers enrolled in the employee pension fund will apply.

- 110. In order to guarantee the continuity of the functions transferred pursuant to paragraphs 103 to 118, a contingent of personnel not exceeding 100 identified, among the permanent employees in service at the INPGI on the date of 31 December 2021, through a selection procedure aimed at ascertaining the suitability in relation to the target professional profile, as well as at assessing the skills in relation to the functions to be performed, is classified at the INPS. The selection procedure is completed within three months from the date of publication of the decree referred to in paragraph 111. By decree of the Minister of Labor and Social Policies, in agreement with the Minister of Economy and Finance and with the Minister for public administration, the personnel who obtain a positive evaluation in the selection procedure are classified in the relative roles on the basis of the comparison table referred to in paragraph 111. Consequently, the INPS staffing is increased by a number of posts corresponding to the units ' of personnel transferred.

- 111. By decree of the Minister of Labor and Social Policies, in agreement with the Minister of Economy and Finance and with the Minister of Public Administration, to be issued within sixty days of the date of entry into force of this law, defined, in compliance with the principles established by article 35, paragraph 3, of the legislative decree of 30 March 2001, n. 165, the methods for carrying out the selection procedure referred to in paragraph 110, as well as the comparison table applicable for the purposes of classification in the INPS roles of the selected personnel, within the limits of the financial resources referred to in paragraph 115.

– 112. Employees coming from INPGI maintain the fixed salary received on the date of classification, as well as the social security regime envisaged for them on the same date. In the event that the aforementioned economic treatment is higher than that enjoyed by personnel already employed by INPS, an ad personam check is recognized for the difference, which can be reabsorbed with the subsequent economic improvements achieved for any reason

- 113. In order to promote rapid and effective integration of functions, an Integration Committee has been set up consisting of the general manager and three INPGI executives, in office as of 31 December 2021, as well as four executives in charge of functions of INPS general management level, coordinated by the general manager of INPS, with the task of achieving the unification of operational and current procedures by 31 December 2022. The members of the Committee are not paid attendance fees, fees, reimbursements of expenses or other emoluments however denominated. The implementation of this paragraph must not result in additional burdens for the public finance. The Committee exercises the functions referred to in the first period until 30 June 2022.

- 114. By decree of the Minister of Labor and Social Policies, to be adopted within three months from the date of entry into force of this law, it is established, in accordance with the principles referred to in article 3, paragraph 4, of the decree legislative June 30, 1994, n. 479, the integration of the INPS Steering and Supervisory Board with two members designated to represent the trade union organizations most representative of the journalist category

– 115. Starting from the date of entry into force of this law and until the date referred to in paragraph 103, the INPGI bodies can carry out acts of extraordinary administration only after notification to the supervising Ministries. The administrative bodies of INPGI adopt, by 30 September 2022, the report as at 30 June 2022 of the replacement management of the compulsory general insurance, to be sent to the Ministry of Labor and Social Policies and to the Ministry of the Economy and of finances, for the purposes referred to in article 3, paragraph 3, of the legislative decree of 30 June 1994, n. 509. Within fifteen days from the date of adoption of the reasoned final decision on the aforementioned report, pursuant to article 3, paragraph 3, of the legislative decree of 30 June 1994, n. 509, and on the basis of the results of the same, with a resolution of the INPGI board of directors to be sent for approval to the Ministry of Labor and Social Policies and the Ministry of Economy and Finance, the resources instrumental and financial pertaining to the same management

– 116. By 30 June 2022, the INPGI shall, with autonomous resolutions subject to ministerial approval pursuant to article 3, paragraph 2, of the aforementioned legislative decree n. 509 of 1994, to the modification of the statute and internal regulations, according to the principles and criteria set out in article 6, paragraphs 1 and 3, of the legislative decree 10 February 1996, n. 103, for the purpose of adapting to the function of social security and assistance institution for professional journalists and publicists who carry out independent journalistic professions, also in the form of coordinated and continuous collaboration. Within fifteen days of the date of approval of the statute by the supervising Ministries, elections are called for the renewal of the Institute's bodies. These bodies enter into office on a date subsequent to that of approval by the supervising Ministries of the resolution to transfer the instrumental and financial resources, referred to in paragraph 115.

– 117. In order to guarantee the continuity of the services charged to INPS, starting from 1 July 2022, the same Institute is authorized to make recourse to advances from the state treasury to be extinguished by 31 December 2022.

– 118. In article 16-quinquies of the decree-law of 30 April 2019, n. 34, converted, with amendments, by law 28 June 2019, n. 58, paragraph 2 is repealed. Until 30 June 20, with reference only to the substitutive management of the compulsory general insurance of the INPGI, the effectiveness of the provisions of paragraph 4 of article 2 of the legislative decree 30 June 1994, n. 509.
