The generational change of civil servants begins. Yesterday the minister of the Pa, Marianna Madia, signed a circular confirming and regulating mandatory exit (with few exceptions) by the Public Administration for those who have reached retirement age. The document must now be registered by the Court of Auditors.

The Madia decree of last summer provided that after 31 October 2014 (31 December 2015 only for magistrates) the practice of detention in service was abolished, which allowed civil servants to continue working even after having obtained the requirements for retirement . The termination of the employment relationship has therefore become "mandatory, for those who have accrued the requisites for an old-age pension or the right to an early pension, having reached the statutory age limit".

Now, "since the deadline of 31 October 2014 has already expired", "the detentions cannot continue", reads the circular, and "to this end, the detentions already arranged and effective are considered to exist. The detentions already agreed but not yet effective as of 25 June 2014 (date of entry into force of the decree-law) are understood to be revoked ex lege".

If a public employee is not yet entitled to a social security allowance despite having reached the age required for an old-age pension, the employment relationship continues "to allow the employee to meet the minimum requirements for access to retirement no later than reaching the age of 70".

On the other hand, the previous rules continue to apply for medical and healthcare executives: maximum limit for retirement upon completion of the 65th year of age "or, at the request of the interested party, upon completion of the fortieth year of effective service, in any case with a maximum limit of permanence to the seventieth year of age".
