Ligresti, seizure of 120 million euros

The civil judge of the Court of Milan Angelo Mambriani has accepted the request for a precautionary seizure for 120 million euros, out of the 440 million requested, against Salvatore Ligresti, his daughters Giulia and Jonella and the ex-managers Fausto Marchionni and Antonio Talarico.

The decision falls within the scope of the civil lawsuit initiated by the ad acta commissioner of Fonsai and by Unipol, which since last October has approved the merger with the insurance group previously owned by the Ligrestis.

In the ruling, the judge rejects the objections presented by the Ligrestis relating to the indemnity signed with Unipol in January 2012 and also that relating to the so-called papello signed between Alberto Nagel, CEO of Mediobanca, and Salvatore Ligresti, relating to the 45 million euro equivalent of the Premafin shares of the family . In detail, the Mediobanca papello, writes Mambriani, "at present, it seems to be able to legitimize a mere expectation, as such insufficient to integrate a patrimonial guarantee that can be assessed here, certainly not a credit right and, on closer inspection, not even a dispute right ”.

The judge also writes that "a group of people was installed at the top of Fonsai, i.e. the members of the Ligresti family, among whom there was an agreement aimed at managing the company for their own personal benefit, with multiple co-existing purposes: maintenance of control, distribution of dividends, execution of real estate transactions”.

Mambriani then identifies illegitimacy profiles of a series of real estate transactions and the damage caused to Fonsai and other group companies, as well as the illegitimacy of compensation paid to Jonella Ligresti in relation to the position of chairman of the board of directors of Fonsai, covered during three terms from 2003 to 2012.
