“Sleeping” savings accounts: the statute of limitations will start after 10 years

The Senate Finance Commission is approving a law that will put an end to the dispute between banks/post offices and customers on the return of the sums deposited in the so-called "dormant": the right to the return will be valid for 10 years and after that the statute of limitations will start

Stop the disputes between banks/post offices and customers for the return of what was deposited in so-called "dormant" savings accounts. The statute of limitations for the repayment request is set at 10 years: the question, which is being examined by the Senate Finance Commission, is being defined in the deliberation session. It all stems from the fact that numerous disputes have arisen between banks and citizens precisely in relation to the refusal at times opposed by the depositor to collect the credit remaining on bank accounts and deposits that have not been handled for several years, citing reasons such as the limitation of the right to the refund of the amount or due to the expiry of the terms for keeping the accounting documentation relating to the account, deposit or passbook, which would not allow the traceability of the deposit to be established with certainty.

In the text finalized in the Finance commission of Palazzo Madama, by unifying two bills, 2 principles are established: the right of a savings book depositor to have the bank repay the sums contained therein and the relative terms of effect of the prescription of the right of the depositors to the repayment of the sums due to them. In detail: "Where, in the contract for the opening of a bank or Poste Italiane SpA savings book, the parties have not provided for an expiry date for the contract itself, the bank returns the sums deposited in the savings book itself at the request of the depositor".

Then the prescription: "In the absence of an expression of will from the bank or Poste Italiane SpA to withdraw from the contract, the right to the repayment of the credit is prescribed after ten years from the date of the request for repayment by the depositor". The president of the finance commission has proposed that this text be examined in the deliberative session and the proposal has been accepted by the parliamentary groups.
