The Chamber has given the first green light to the decree against EU infringements that now goes to the Senate. Here are the new rules foreseen for beach concessions

First green light from Parliament to the new rules on bathing concessions contained in the anti-EU infringement decree approved on Wednesday by the Chamber with 144 votes in favor and 83 against. The measure now goes to the Senate for consideration.

According to what is foreseen, the maritime, lake and river state concessions for the exercise of tourist, recreational and sporting activities will be extended until September 30, 2027, with the possibility of extending the deadline until March 31, 2028 in the event of pending disputes or other objective reasons for difficulty in carrying out the tenders. However, the Municipalities will have the obligation to give the bidding starts by June 30, 2027. 

The outgoing beach workers will be granted indemnities, to be paid by the incoming bidders, but there will be no pre-emption rights in their favour in the tenders. 

For the canons, it will be up to the Ministry of Infrastructure and Transport to establish an adjustment. In the event of failure to adopt the measure, they will still be increased by 10 percent.

New concessions: here are the criteria

From a minimum of 5 to a maximum of 20 years, this will be the duration of the new beach concessions. Exemption for sports clubs

The amendment on sports clubs also passed, which, based on the Government reformulation approved in the Commission, provides that fall outside the scope of the Bolkestein directive maritime, lake and river state concessions if their use is related to the performance of a long series of sporting activities which “can be considered as non-economic activities under European Union law”.
