The Lazio Regional Administrative Court rejects Telecom Italia's requests for suspension of the definitive award provision to Open Fiber of the tender procedure called by Infratel.

The Lazio Regional Administrative Court rejects Telecom Italia's requests for suspension of the definitive award provision to Open Fiber of the tender procedure called by Infratel. The application concerned the assignment of a concession for the "construction, maintenance and management of the publicly owned passive ultra-broadband network" in the areas of the territory of the Abruzzo and Molise, Emilia Romagna, Lombardy, Tuscany and Veneto regions.

The administrative judges have set the hearing on the merits for December 4th. The Regional Administrative Court considered that "the questions raised in the context of the appeal in question require the typical in-depth analysis of the seat of merit through the celebration of the public hearing which can now be set for December 4, 2017", also for the purpose " to have a complete picture of the litigation".

After the decision of the Administrative Judges, Infratel (a subsidiary of Invitalia) will be able to immediately proceed with the signature
of the contract, starting the construction of an innovative and strategic infrastructure for the development of the country, as well as removing the risk of not being able to use the European funds destined for this project, as has happened too many times in the past in our country, only rarely for understandable reasons.
