Pa reform, go-ahead from the government: from article 18 to the crackdown on crafty people, here's the news

The first green light from the Council of Ministers arrives for five implementing decrees of the reform of the public administration by Madia, which thus reaches the finish line. However, the discussion on the decrees remains open, because the provisions will then have to go to the Council of State and to the parliamentary commissions. It will also be necessary to agree with the local authorities.

Here are the main contents of the reform to date:

ARTICLE 18

Unlike in the private sector, in the PA the old-fashioned article 18 remains in force, therefore with the reinstatement. On one aspect, however, it is in line with the private sector: the compensation cannot exceed 24 months' salary.

PRODUCTIVITY AWARDS

On this front, the national contracts will decide, which will however have to guarantee differentiations based on the report cards of the employees.

TWO ANTI-PRECARIATE MEASURES

The first is an extraordinary recruitment plan for those who have completed at least three years of service, even non-continuous, to be implemented with competitions reserved for precarious workers who have not passed selections in the past. The second is the stop to co.co.co contracts.

EXCEEDING THE CURRENT "WORKFORCE".

They will be replaced by a program that will be able to differentiate the turnover constraints even within the individual sectors of the Public Administration, with the intention of "rewarding" the entities based on the activities carried out and therefore on the need for personnel.

HOW COMPETITIONS AND RANKINGS CHANGE

The recruitment system changes: no more endless rankings, suitable candidates are identified in no more than 20% of the places available (in the past the list of suitable candidates was much longer than that of winners). In the competitions, IT knowledge and command of the English language, as well as, where appropriate, other foreign languages ​​must be verified. Furthermore, "for specific profiles or job levels", it is possible to request "possession of the title of research doctor". Among the innovations, also the "possibility of providing for a maximum number of qualifications that candidates can submit for evaluation by the commission".

STRETCH ON THE WEEKEND SCAMMERS AND THE ABSENTEEISTS

Anomalous absenteeism tightened to hit the so-called 'cunning' at the weekend (those who repeatedly skip Monday and Friday). National contracts must prevent increases in ancillary treatments at the administration level in cases of disclosures of 'strategic' absences, i.e. those which are concentrated in critical periods for services or in continuity with holidays and rest days higher than the national average data or of sector. In the event of "anomalous and repeated" absences, the contracts set the disciplinary sanctions. Change of pace also in the checks to clarify the 'disease' of workers, thanks to the new single center of fiscal medicine for public and private sectors. Medical-legal checks on sick employees are "carried out exclusively by INPS", which enters into special agreements with tax medicine doctors. The hours of availability for tax visits are harmonized between public and private and have a "systematic and repetitive" cadence.

EVALUATION OF PERFORMANCE

Every public administration is required to measure and evaluate performance with reference to the administration as a whole, to the organizational units or areas of responsibility into which it is divided and to individual employees or groups of employees. The independent assessment bodies will have to verify the performance trend with respect to the planned objectives during the reference period and report any need for corrective action. For the first time, an active role of citizens is recognized for the purposes of evaluating organizational performance, through the definition of systems for detecting user satisfaction with regard to the quality of services rendered.

OK TO THE CORRECTIVE DECREE OF THE PROCUREMENT CODE

The Council of Ministers also approved the "corrective decree to the procurement code for greater simplicity and transparency and to try to make a contribution to the recovery of public procurement and works", announced Prime Minister Paolo Gentiloni at the end of the CDM.
