Tax reform, a rule appears to save Berlusconi

The rule which provides for the exclusion of punishment for deviations of 3% on personal income tax and VAT would guarantee Berlusconi the cancellation of the four-year sentence in the Mediaset trial and the possibility of reapplying - Ghedini denies: "Applies only to unfaithful declarations", but many experts believe that written in this way also extends to tax fraud

Tax reform, a rule appears to save Berlusconi

In the tax reform there is a rule that would be a "save-Berlusconi". In particular, it is the one introduced in the legislative decree approved on Christmas Eve by the Council of Ministers, which - in the matter of tax crimes - provides for the exclusion of the punishment "when the amount of income tax evaded does not exceed 3% of the declared taxable income or the value added tax amount evaded does not exceed 3% of the value added tax declared”.

As various newspapers report, it is not clear who the author of the decree is, whether he resides in Padoan's economy ministry or in Renzi's Palazzo Chigi, but the novelty would guarantee Silvio Berlusconi the cancellation of the four-year sentence in the Mediaset trial for fraud tax. Decriminalization would allow him to run again.

It's really like this? “Absolutely not, it doesn't concern Berlusconi – says his lawyer, Niccolò Ghedini-. This article refers only to the misrepresentation”. But for many legal experts, the rule, thus written, would also apply to false invoices and tax fraud. Which in the specific case of Berlusconi would be below the expected threshold of 3%.
