Lawyers' civil liability insurance becomes mandatory and Aon, the leading group in Italy and in the world in risk and human resources consultancy, insurance and reinsurance intermediation, has assisted the National Bar Council in carrying out the tender for the assignment of insurance services for lawyers, defining the necessary regulatory and economic conditions, in view of and in compliance with the imminent entry into force on 10 November of the insurance obligation for lawyers.
The Ministry of Justice has postponed the entry into force of the new regulatory provisions - initially scheduled for 11 October – to allow lawyers to comply with the obligation to communicate the details of the policies to the council of the Bar to which they belong, as required by the forensic reform (law 247/2012), as well as to accurately evaluate the different solutions on the market and ensure that the policy underwritten includes the essential conditions and the minimum coverage provided.
The National Forensic Council has signed an agreement on a national scale with the insurance company AIG Europe, which won the tender, for an insurance policy with particularly favorable conditions for Lawyers and Professional Orders, to cover the professional civil liability and accidents of the professional and his collaborators, employees and traineesderiving from the exercise of the legal profession.
The policy put out to tender by the National Forensic Council, brokered and managed by Aon, in addition to incorporating all the requirements established by the Ministerial Decree of 22 September 2016, is characterized by being first policy in Italy with contextual coverage for civil liability and for accidents and to have among the qualifying points the unlimited retroactivity and ultraactivity in the event of cessation of the activity, the prohibition of withdrawal by the Insurer in the event of an accident and the right to reinstate the maximum amount in the event of an accident . The policy also offers a favorable regime for young lawyers with premiums starting from €117, Cyber liability (i.e. a policy against liability deriving from cyber attacks) and coverage of the liability of the Lawyer Employed by a Public Body for tax damage.
In order to speed up and facilitate the adaptation of lawyers to the legislation, the National Forensic Council has created a section dedicated to professional civil liability lawyers on its website – http://www.consiglionazionaleforense.it/web/cnf/sicurezza-obbligatoria -, from which it is possible to directly access Aon's Avvocati by One Affinity portal, which provides professionals with timely information on the policy, insights and gives the possibility to request quotes and sign up for the chosen coverage online quickly and easily. Aon also provides a customer care service dedicated to lawyers to provide them with useful information, if needed. Thanks to the team of specialists of the Claims Department, qualified assistance is also offered in the phases of handling claims generated by errors committed during the professional activity.
