Imu, Tasi and fake news on foreclosures: only the procedure changes

Salvini speaks of the "Soviet Union", but the novelty introduced by the maneuver is only a simplification of the collection procedures for the mayors: the Municipalities have always been able to seize current accounts

You don't pay the Imu, the Tasi, the Tari and the Municipality you foreclose the current account in record time? We talk about matter in article 96 of the 2020 maneuver which - in an anti-evasion key - reforms the collection methods of local authorities.

Let's make it clear right away fines for infringements of the Highway Code they have nothing to do with it: they are explicitly excluded by the legislation.

The article in question (which in any case could be modified during the parliamentary process of the manoeuvre) simplifies the recovery of unpaid local taxes, which is estimated to amount today to approx 19 billion euros. In essence, from 2020 January XNUMX the Municipalities will be able to follow a simpler procedure: they will send a single assessment deed which will contain all the elements of title also suitable for the attachment of the current account or one fifth of the salary.

After that, within three months of notification of the missed payments, the Municipalities will be able to activate the collection procedures, which will remain suspended for another six months to allow interested parties to comply. From the notification of non-payments to the initiation of the compulsory collection procedure (administrative detention, mortgage, attachment or expropriation) at least nine months will then pass. Provided that in the meantime the taxpayer has not appealed. This is exactly what is already happening today with the collection of state taxes entrusted to the Agenzia delle Entrate – Collection.

The news for the Municipalities is only one: the intermediate step of sending the tax collection notice disappears. For the rest, nothing changes: local authorities already have the power to seize salaries and current accounts, but with longer times.

There also remains the possibility of pay in installments for those who find themselves in a situation of "temporary and objective difficulty". In particular, the sums between 100 and 500 euros can be paid in four installments, otherwise this scheme is followed: from 5 to 12 installments if the amount is between 500 and 3 thousand euros; from 13 to 24 installments of up to 6 thousand euros; from 25 to 36 installments up to 20 thousand euros and from 37 to 72 installments over this threshold. 

To collect up to 10 thousand euros, before activating a forced recovery procedure, the institutions will have to send a payment reminder to notify the debtor that the term indicated in the deed has expired.

To journalists who asked him about the new standard, Giuseppe Conte he answered: "Citizens need not worry."

From the opposition, the secretary of the League, Matteo Salvini, did not miss the opportunity to attack the government: "If they enter your current account to seize, in my opinion we are in the fiscal Soviet Union, the tax police state". But these were already the rules: even when Salvini was in government. Finally, it should be remembered that about 3 Italian municipalities out of 8 have entrusted the tax recovery service to the Revenue Agency. It is likely that, even with the new procedures, they will continue to do so since debt collection is expensive and requires structures that only large cities can put in place.
