Electronic communications, Agcom-Unioncamere protocol

Signed by the president of the Communications Guarantee Authority, Angelo M.Cardani, and by the president of Unioncamere, Ferruccio Dardanello, a new memorandum of understanding to establish methods and principles applicable to the settlement of disputes between users and operators of electronic communications at the Chambers of Commerce (CCIAA).

It was signed by the president of the Authority for guarantees in the communications, Angelo M.Cardani, and by the president of Unioncamere, Ferruccio Dardanello, a new memorandum of understanding to establish methods and principles applicable to the settlement of disputes between users and operators of electronic communications in the Chambers of commerce (CCIAA).

By virtue of the collaboration agreement, which follows that experimental signed in March 2012, the Chambers of Commerce will be able to continue to carry out, as an alternative to Corecom, conciliations on the subject of electronic communications that will be valid for all purposes, therein including the value of enforceable title for the conciliation report. 

Unioncamere, in its capacity as an association of all the Chambers of Commerce, it will guarantee the use of common procedures throughout the territory national, in compliance with resolution no. 173/07/CONS of Agcom, also ensuring enforcement, for disputes regarding communication electronic, with a reduced rate of up to half of the sum foreseen for the other mediation procedures not mandatory. Furthermore, thanks to the new Protocol, the exemption of startup fees, provided for disputes involving consumers, will also extended to operators, so as to encourage them further participation.

The signing of the Protocol represents a confirmation of the role played by Chambers of Commerce in the settlement of disputes between operators ed users, sanctioned by the law n. 481 of 1995 and then confirmed by results achieved over the years, so as to accredit the Chambers of Commerce as the third pillar, together with Corecom and conciliation "equality", on which the success of the system is based conciliation in matters of relations between users and operators of electronic communications.

“For the Chamber of Commerce conciliation desks disputes in communications matters account for almost a third of the effort of the 105 structures active in the Chambers of Commerce”, he underlines the president of Unioncamere, Ferruccio Dardanello. “To ours structures, 20% of the requests for compulsory mediation arrive, which from March 2011 to date there are almost 50.000. This is also one of many ways in which the Chambers of Commerce fulfill their function as institutions of market regulation".

“The renewal of the protocol – recalled the president of the Authority, Angelo M.Cardani – completes the set of tools available to Agcom to deal with disputes between users and operators and ensure, together with the activity carried out by Corecom e to the collaboration with the Associations of the consumers, effective, rapid, economic and close to justice citizen. A formula – he added – whose success is confirmed from the numbers of the instances examined - a total of almost 100 thousand in 2013 – over 70% concluded successfully to their advantage of consumers".
