The Association of Italian Joint-Stock Companies presents 20 proposals to restart the economy – Among these, also the revision of some crimes and the complete rethinking of the Anti-Corruption Authority

Cantieri, Anac, Pa: Assonime calls for a revolution

Increase the PA's ability to act in a result-oriented manner; remove the blocking factors in terms of infrastructure and public contracts; simplify the restart of the economy. These are the three chapters in which Assonymous has collected 20 proposals to the government and Parliament to overcome "the most serious post-war economic crisis caused by the Covid-19 emergency".

The report was produced by a task force of experts and entrepreneurs set up by the Presidential Committee of the Association of Italian Joint-Stock Companies. In addition to the president, Franco Bassanini, the team is made up of Luigi Abete, Ginevra Bruzzone, Marcello Clarich, Matteo Del Fante, Pietro Guindani, Luciano Panzani, Pietro Salini and Luisa Torchia.

Let's see what are the main interventions proposed by Assonime.

1) PUBLIC ADMINISTRATION

  • Tax damage: consider responsible only those who have acted with malice, deleting "gross negligence" from the law.
  • Office abuse: suppress the crime or define the case in a more precise way.
  • Controls: shift from ex ante to ex post, so as to verify the result and impact of the administrative action.
  • Break the inertia: strengthen the commitment of managers and top politicians to encourage "doing", applying the rules that already exist.
  • More rigorous selection: the recruitment program to rejuvenate the PA should favor specialized profiles with technical skills.
  • Public databases: ensure full interoperability, if necessary via a Commissioner.

2) INFRASTRUCTURE AND PUBLIC CONTRACTS

  • Unlocking construction sites: use the tool of the Extraordinary Commissioner for priority works and provide the Municipalities with resources to be spent within certain times.
  • Chipe: improve its functioning through measures aimed at making decision times more certain and rapid.
  • Code of public contracts: eliminate for at least two years certain constraints not envisaged by EU directives, for example by removing certain constraints on public-private partnerships and allowing the negotiated procedure without publication of the call for tenders for works of up to five million euros.
  • Anac: eliminate the Authority's regulatory powers in the public procurement sector and the ex ante control functions, instead strengthening the system support tasks (database management, dissemination of best practices) and ex post controls. On an organizational level, separate the fight against corruption within the Anac from the supervision of public contracts.

3) SIMPLIFICATION

  • Service conference: confirming the decisions in cases where the dissenting administration does not obtain a decision from the political organ of last resort (Council of Ministers or Regional Council) within a certain (and short) term.
  • Time cutting: extend the application of tacit consent and reduce the time required for the automatic annulment of illegitimate measures from 18 to 6/9 months.

Lastly, the Report contains a series of simplification proposals in some key sectors for the economy: from the provision of support measures to citizens and businesses to the electronic communications sector, from the cultural sector to those of energy, the environment and construction for urban redevelopment.
