Bank of Italy's lawyers clarify that the trustee created last January will not be able to sell the Fininvest shares in Mediolanum before January 2016.

The newly formed trustee can sell the stake Fininvest in Mediolanum only starting from January 2016. This is supported by the lawyers of the Bank of Italy (Olina Capolino, Marco Mancini, Michele Cossa and Guido Crapanzano) in the brief filed with the Lazio Regional Administrative Court for the council session scheduled for today on the suspension requested by Silvio Berlusconi , together with Marina Berlusconi's Holding Italiana Quarta against the provision of Palazzo Koch which forced Fininvest to sell the shares exceeding 10% of Mediolanum, following the loss of the honourability requirements of the former prime minister.

The trustee, therefore, will not be able to sell Fininvest's stake in Mediolanum before January 9 next year. According to Bankitalia's lawyers, until 9 January 2016 alienation is absolutely not permitted, while the prohibition of alienation of the shareholding before 18 months from the establishment of the trust, and therefore until 9 July 2016, is valid unless there are "conditions so advantageous that, far from being able to configure any prejudice, they ensure Fininvest an extraordinary profit".
