Banks: appeals to the Abf decrease, customers recover 31 million but the dispute on electronic payments rises

To the Italian savers who have done appeal due to banking or financial issues they were returned last year 31 million euro (compared to 29 million in 2020), of which over 20 million were actually returned to customers by intermediaries.
The annual report on the activity carried out by theBanking and financial arbitrator (the body set up by the Bank of Italy to settle disputes between bank intermediaries and customers) specifying that the average duration of the procedure was 137 days, therefore less than the 180 days envisaged by the legislation and that 85% of the procedures was completed within this period.

2021 was characterized by a decrease (-28 percent) in the number of appeals presented (over 22.300) and by a redistribution of the same by subject matter.
Since 2015, more than 135 million euros have been recognised.

Recourses to foreign banks and electronic money institutions are growing

In detail, the Bnaca d'Italia report notes that in 2021 the number of appeals to foreign banks and electronic money institutions increased by 29 and 55 percent respectively, which can be seen as part of a significant redistribution of appeals by subject.
According to the report, litigation on the subject of payment services and tools (by 52 per cent), also due to the greater diffusion of digital payments during the period of the health emergency.

On the other hand, the reduction in litigation regarding postal savings bonds (-31%) and salary-backed loans (Cqs) (-55%) continues, even if the latter continue to represent the largest number of appeals received (approximately 34 percent of the total).
Over 27.400 decisions were taken by the Colleges: in most cases the outcome was total or partial acceptance of the requests (48%), or declaration of the cessation of the disputed matter due to the agreement reached between the parties (17% ).

Collaborations with Ivass and Consob Arbitrators are growing

The new ABF provisions on the procedure have been applied (aligned with directive EU/2013/11 implemented in Legislative Decree 130/2015) and the new amount that can be requested from the Arbitrator (doubled and brought to 200.000 euros).
The collaboration with the Institute for the insurance supervision (IVASS) in view of the establishment of the Insurance Arbitrator, also through work exchanges between the personnel of the Bank of Italy and that of IVASS. And the memorandum of understanding of March 2020 was also implemented with the Arbitrator for Financial Disputes (ACF) set up at Consob.

ECB supervision: banks' non-performing loans drop to 1,95%, lowest since 2015

Today the data on the non-performing loans (Npl) of the banks supervised by the ECB which still showed a reduction, as shown by its quarterly statistical bulletin of the Supervision. The aggregate data as at 31 March shows that non-performing loans in relation to total loans are down at 1,95% (the lowest level since the start of the Supervisory statistical surveys from the second quarter of 2015) from 2,06% in the previous quarter even if the performing loans most at risk of becoming impaired, those defined as 'stage2', continue to grow and reach 9,28% of the total (9,14% in the previous quarter).

The ECB, on the other hand, also shows a weakening of the aggregate capital ratio (Cet1) to 14,98% in the first quarter (from 15,57%). The attached graphs show that Italian banks are slightly below the Eurozone average for this ratio relative to the best quality, but it is slightly above the average both if we consider the Tier1 ratio and if we look at the Total capital ratio. 

On the list of Borsa Milano it is the banks that weigh. Bpm bank halfway through the session it dropped 2,12% to 2,537 euros after losing up to 4% at the start, Bper loses 3,58% to 1,46 euros, Unicredit 1,23% to 9,38 euros, while Intesa Sanpaolo it drops by 0,61% to 1,75 euros
