From April 1st the rules on smart working will change again. After the stalemate of Parliament, which rejected the amendment to the Milleproroghe decree, from Monday all the "special" rules in force since 2020 will cease and remote working will once again be regulated by ordinary legislation provided for by law n.81/2017. A step backwards that will weigh on both public and private workers, including parents of children under 14 and vulnerable workers who have until now enjoyed different benefits.

Anyone who wants to continue working in smart working must sign an individual agreement with your company and agile working thus becomes a "performance execution method".

Smart working: what changes from April 1st

The revolution arrived in the first months of the pandemic, when millions of workers found themselves working from home to meet their "distance" needs. Then, we moved on from extension to extension and, as time passed, the simplifications remained only for i parents with children under 14 and vulnerable workers. From April 1st onwards these will also disappear.

It will therefore be necessary for all workers to sign an agreement with the company, as provided for in article 19 of law 81 of 2017 and without simplified regimes or shortcuts. The company agreement, which is followed by the individual one, must contain all the parameters from consider for carrying out the work activity: the duration, the alternation methods, the places possibly excluded, the aspects relating to the employee's conduct and the management power of the managers in moments of smart working, methods and use of work tools, rest times and the measures to ensure disconnection, the methods of monitoring performance outside the company premises, any training necessary and the methods of exercising trade union rights.

Smart working in the private sector: what changes from April 1st

Until March 31, 2024, i private sector workers with children under 14 they could request smart working if, within the family, there was no other non-working parent or they did not benefit from other income support tools recognized in the event of suspension or cessation of working activity. Similar rules also for the fragile.

Starting from April 1st, all private workers will be able to work smart only in the presence of a agreement between employer and employee, without any priority criteria for access. After having negotiated the agreement, it will be up to the employer to carry out the telematic communications necessary to activate it. In case of delays you risk administrative fines of up to 500 euros.

Smart working in the public sector: the rules from April 1st

Already since last December 31st, for the fragile workers in the public sector, the simplifications on smart working had ceased. Since the beginning of the year, therefore, based on the directive of 29 December 2023, in the public sector it is the responsible manager, within the organization of each administration, to have to "identify the necessary organizational measures, through individual agreements for the protection of the subjects most exposed to health risk situations" for the performance of the service in agile mode.
