The House Chamber has given the green light to the Dignity Decree with 312 votes in favour, 190 against and one abstention. The text now goes to second reading in the Senate. The majority is aiming for definitive approval before the summer break, otherwise it would come too close to September 12, the date of forfeiture of the decree. It is therefore very probable that the version of the text released by Montecitorio is the definitive one and it cannot be excluded that, to lock down the provision and cut the deadlines, the Government will ask the question of trust in Palazzo Madama.

Here are all the measures contained in the Dignity Decree, starting with the most important novelty introduced via amendment to the Chamber to restore peace of mind in relations between the Government and entrepreneurs.

UNDER 35 RECRUITMENT BONUS UNTIL 2020

Companies that will hire under 35 workers on a permanent basis will benefit from the incentives currently in force - a three-year contribution discount of 50% with a ceiling of 3 thousand euros - also in 2019 and 2020. The bonus active up to now, in the version launched by the Gentiloni government, provided for the halving of contributions on the hiring of under 35s for this year alone. From the next, the bar would drop to 30 years. The amendment to the dignity decree intervenes precisely on this point, confirming the 35 quota also for 2019 and extending it to 2020. The cost of the measure is 600 million until 2024, covered in part with a rise in taxes on gaming and in part with revenues from the projected increase in employment.

WORK: LENDANCES, RENEWAL, CAUSES

Permanent contracts:

  • the indemnity for workers dismissed without just cause goes from a maximum of 24 months to a maximum of 36 months.

Term contracts:

  • the maximum duration of the contracts is reduced from 36 to 24 months;
  • for each renewal starting from the second, there is a 0,5% increase in the additional contribution (currently equal to 1,4% of the taxable salary for social security purposes); the burden will not weigh on the families who employ cleaners or carers (according to Assindatcolf, the cost would have been 160 euros per family);
  • the possible extensions are reduced from 5 to 4;
  • the reasons are back: it will be necessary to indicate them in contracts longer than 12 months and in all renewals. The contracts of seasonal workers are excluded from this novelty.

Employment protection with state aid:

  • if a company receives state aid but cuts jobs in the next 5 years, the benefits are withdrawn.

TRANSITIONAL PERIOD FOR NEWS ON PRECARIAT

The new rules for fixed-term contracts do not apply to extensions and renewals signed up to 31 October 2018.

SANCTIONS FOR THOSE WHO VIOLATE THE RULES ON PRECARIAT

If a contract lasting more than 12 months is stipulated in violation of the causal obligation, the transformation into an open-ended contract is automatically triggered.

And when the administration of work "is carried out with the specific purpose of circumventing mandatory provisions of the law or of the collective agreement applied to the worker, the administrator and the user are punished with a fine of 20 euros for each worker involved and each day of administration" .

VOUCHERS ALSO IN TOURISM

The vouchers can also be used in the tourism sector, as well as in agriculture, but only for activities with up to 8 employees. Furthermore, as already foreseen, they can be used as a form of payment for the work of pensioners, the unemployed, students up to the age of 25 and recipients of forms of income support. The maximum duration of use increases from three to ten days.

CONTRACTS RATES

The share of employees hired with fixed-term contracts "cannot exceed 30% of the number of permanent workers employed by the user on January 0,5 of the year of stipulation of the aforesaid contract, with a decimal rounding up to the next unit if it is equal to or greater than XNUMX".

CONCILIATION OFFERS

In the event of dismissal, the conciliation offer, which today can fluctuate between a minimum of one and a maximum of 18 months' salary, may be set between 3 and 27 months' salary.

FINES FOR THOSE WHO RELOCALIZE AFTER TAKING PUBLIC MONEY

Companies that have received public aid and move production to other countries within the next 5 years will receive penalties of 2 to 4 times the economic benefit obtained, which will also be repaid with interest increased by up to 5 percentage points. The recovery of hyper-depreciation in the event of relocation or sale of investments is also envisaged.

PAYABLE CREDITS OFF TAX PAYABLES

The companies that have credits with the PA and debts with the tax authorities will be able to offset them again in 2018.

GAMBLING: STOP ADVERTISING, UP TAXES

Gambling advertising will be banned from 2019. Violators will be punished with a fine equal to 20% of the value of the sponsorship or advertising (no longer 5%, as envisaged by the original text of the decree), but the amount cannot in any case be less than 50 thousand euros. Proceeds will go to the anti-gambling fund. Penalties ranging from 100 thousand to 500 thousand euros remain for those who violate the ban during shows dedicated to minors. Lotteries with deferred draws (such as the Lotteria Italia) and existing contracts (but for a maximum of one year) are excluded from the ban on advertising.

From September 19,25, the single tax levy (PREU) will rise to 6,25% on slot machines and 0,25% on video lotteries. Another XNUMX% hike on both games will come on May XNUMX next year. The increases will serve to cover the drop in VAT revenues caused by the ban on advertising.

HEALTH CARD FOR SLOTS

To play the slot machines it will be necessary to insert the health card into the device, "in order to prevent access to games by minors". Non-homologated slots are to be phased out by 2020.

“NO SLOT” LOGO FOR BARS

The Mise will establish the "no slot" logo for commercial activities that have not installed entertainment machines.

“HAMERS YOUR HEALTH” ALSO ON SCRATCH CARDS

As on cigarette packets, the wording "harmful to health" will also appear on scratch cards. The coupons must contain messages on the risks associated with gambling "in order to cover at least 20%" of the surface "on both sides". The old coupons without notice can still be sold for one year from the date of conversion of the decree.

ELECTRONIC INVOICE: FOR PETROL STATIONS THE OBLIGATION SLIDES TO 2019

The Dignity Decree has absorbed the provision which postpones the rule on electronic invoicing to January XNUMXst, which otherwise would have been mandatory from July XNUMXst of this year for the fuel sector.

RECRUITMENT REGIONS FOR EMPLOYMENT CENTERS

For the three-year period 2019-2021, a portion of the authorized recruitments of the regions, to be defined in the State-Regions Conference, will be "diverted" for the strengthening of employment centres.

OTHER SIZES

Extension for teachers with a master's degree within 2001-2002. The layoffs imposed by the sentence of the Council of State postponed by 120 days, to 30 June 2019. To resolve the situation, an extraordinary competition is on the way, open to graduates in education science and teachers with a master's degree with at least two years of teaching in the last 8.

Skip the 36-month cap for fixed-term employment contracts in the school sector. The measure was contained in the 2015 school reform.

Lo split-payment, i.e. the direct withholding of VAT by the State, is abolished for professionals.

Lo Spesometer it now provides for only one fulfillment per year. The deadline for the submission of third quarter 2018 data has been postponed from the end of November to the end of February 2019, together with the submission of fourth quarter data.

Redditometer: no controls since 2016.
