Marco Tronchetti Provera acquitted. This is the decision of the third court of appeal in Milan which acquitted the vice president and managing director of Pirelli from the charge of receiving stolen goods "because the fact does not constitute a crime" in the third appeal process for the Kroll case.

In 2013, in the first instance, Tronchetti had been convicted to one year and 8 months (suspended sentence) with no mention as a clean record. Two years later, the first appeal ended with an acquittal "because the fact does not constitute a crime" but the sentence was annulled with postponement by the Court of Cassation.

The same happened for the second trial on appeal, closed with an acquittal on February 9, 2017 and sentence annulled with referral by the Cassation on January 11, 2018.

The case dates back to fourteen years ago. It was 2004 and Tronchetti Provera he was president of Telecom Italia. The proceeding revolves around a CD with data collected by the Kroll investigative agency which in 2004, a period in which there was an ongoing clash between Telecom and some Brazilian investment funds for control of Brasil Telecom, carried out an espionage activity against of the telecommunications group and the Tronchetti Provera family.

According to the indictment, those files were intercepted by computer experts of the Tiger Team, structure employed by Giuliano Tavaroli (head of Telecom security), with a hacking operation, and then sent to the secretariat of the former Telecom number one, who, again according to the investigations, despite knowing the ways in which they had been acquired, gave the order to file a complaint by sending the CD to the judicial authority. This reconstruction, however, has always been rejected by Tronchetti Provera, who has always denied any wrongdoing.

Before the judges of the Third Court of Appeal presided over by Francesca Marcelli, the manager had declared that he had "attended a meeting which lasted a few minutes and was called urgently" during which he had been informed "that there was an action against the myself, my family and the company I lead from Kroll. My reaction was to give a mandate to my lawyers, Francesco Mucciarelli and Francesco Chiappetta, to report everything to the Public Prosecutor's Office".

This is the comment of Marco Tronchetti Provera, "This whole affair, with 17-18 charges, ended up in a filing and three times in an acquittal", continued Tronchetti Provera, arguing that the sentence against him is "the answer of justice to those who have tried to alter the truth".
