Wind shortens contracts: fine by the Antitrust

The company has reduced the renewal period for landline telephone offers from 30 to 28 days, requiring customers who have exercised their right of withdrawal to be charged the balance of the remaining installments in a single solution

Wind received a fine from the Antitrust for unfair commercial practices. The fine amounts to 500 euros and punishes the telecommunications company's decision to reduce the renewal period of landline telephony offers from 30 to 28 days.

In particular, the Authority communicates that it has ascertained "the unfairness consisting in having unilaterally reduced the renewal period, among other things, of the offers combined with the installment sale of products (telephone or tablet or mobile Wi-Fi), providing those who had exercised the right of withdrawal will be charged the balance of the remaining installments in a lump sum”.

For the Antitrust, the unilateral imposition of the reduction from 30 to 28 days entailed an economic burden for all customers who did not intend to accept this change. And on the basis of the Consumer Code, the practice was deemed aggressive as it was suitable for limiting the consumer's freedom of choice and the consequent exercise of the right of withdrawal.
