Walk yes or no? The last circular from the Interior Ministry, dated 31 March, containing "clarifications" on movements and gatherings in the time of the coronavirus, has created quite a few controversies throughout the country. The President of the Campania Region, Vincenzo De Luca, spoke of a "very serious and irresponsible message", while the Lombardy Health Councilor, Giulio Gallera, warned of the risk of creating "a devastating psychological effect, nullifying the efforts and sacrifices made so far ”. Harsh criticisms that forced the Interior Ministry to issue a new press release aimed at "clarifying the clarifications" provided 24 hours earlier.

WALK: THE CLARIFICATIONS OF THE VIMINALE

At 10.03 on April 1, the ministry led by Luciana Lamorgese publishes a note entitled: "The clarifications of the ministry after the circular of 31 March on the provisions for the prevention of the Covid-19 contagion".

Inside it is immediately explained that “the travel rules to contain the spread of the coronavirus do not change”. So it remains valid what the Government established in the previous decrees.

The problem is that given the confusion and numerous doubts about the legislation, many citizens are not clear what can be done and what not. 

As for travel, the general rule, reiterates the Viminale, is as follows: 

“You can only leave your home in the cases already provided for by the decrees of the President of the Council of Ministers: for work, for reasons of absolute urgency or necessity and for health reasons”.

Not only, the "general ban on gatherings" remains valid, as well as the obligation to respect the minimum safety distance, equal to one meter. 

Speaking instead of the now famous walks, in the note dated April 1, the ministry clarifies that you can go for a breath of fresh air with your child, but with certain stakes. In detail: 

"It has been specified that the possibility of going out with minor children is allowed for only one parent to walk as long as this takes place near their home and on the occasion of trips motivated by situations of need or health".

No outdoor games, no ball or bicycles. Even in cases where it is permitted, you must stay close to your home (about 200 meters) and keep away from parks, villas, playgrounds and public gardens. 

WHEN YOU CAN TAKE A WALK: THE CIRCULAR OF MARCH 31st

At a general level, the circular of 31 March explains that: 

  1. a parent (only one) can take their child for a walk, always staying close to home, 
  2. you can accompany an elderly or incapacitated person for a walk "for reasons of need or health", always staying close to your home.

On walks with children in fact it specifies: 

“As regards the movement of natural persons, it is understood that only one parent can walk with their minor children as this activity can be traced back to outdoor motor activities, as long as it is close to one's home. The same activity can also be carried out in the context of trips motivated by situations of need or for health reasons"

It should be noted that, according to the Viminale, when it comes to "permitted motor activity" it does not refer to sporting activity, such as jogging for example. 

Movements near one's home justified by the need to accompany the elderly or disabled by people who take care of them may also be allowed, due to the attributability of the same movements to reasons of need or health.
