Vivendi appeals to the Tar against Agcom on Tim-Mediaset

The French giant filed an appeal against the resolution with which Agcom forced the French group to choose between control of Tim and the stake close to 30% in Mediaset - Vivendi ready to freeze the voting rights exceeding 9,9% on the Biscione.

Vivendi launches a counterattack on the Mediaset – Tim affair. The French giant filed an appeal with the Tar against the resolution with which Agcom forced the French group to choose between control of Tim and the stake close to 30% in Mediaset by virtue of the provisions of the Gasparri law on roofs in the media sector and telecommunications.

However, according to the latest rumors, despite the appeal to the Administrative Court, Vivendi would also be ready to present its own proposal. In the meantime, in order to meet Agcom's decision, it will offer to freeze the voting rights exceeding 9,9% in Mediaset. The deadline for presenting the proposal expires at midnight today, June 19th.

We recall that, based on what was approved by the Authority last year, Vincent Bolloré's company would have one year (which started in April) to remove the prohibited position after the complaint made by Mediaset on the French takeover of the Biscione. Agcom has in fact imposed on Vivendi to “remove the prohibited position within 12 months from the date of notification of the provision adopted. In order to allow the Authority to carry out an adequate monitoring activity, Vivendi is required to present a specific action plan within 60 days that the company intends to adopt to comply with the order”.

The plan should arrive in the next few hours and, if it does not comply with the order of the Authority, the French giant could receive a fine of between 2 and 5% of its turnover.
