Green light from the Council of Ministers to the justice plan in 12 points

The Council of Ministers yesterday approved a plan for the reform of justice which will now be submitted for consultation - The acceleration of civil justice processes stands out: a year in all - But also the civil liability of magistrates and the change of criteria for election of the Csm – False accounting is once again punishable.

Green light from the Council of Ministers to the justice plan in 12 points

Here is a summary of the 12 points of the justice reform presented yesterday by the CDM, and which will now be open to discussion for 2 months between insiders and citizens.  

1- CIVIL JUSTICE: The time reduction aims to bring the first instance of the civil proceeding to one year. 

2- CSM: “Whoever judges does not nominate, whoever nominates does not judge”, said Renzi, explaining that the career will be linked to merit

3- CIVIL LIABILITY OF THE MAGISTRATES: News also with regard to the controversial civil liability of magistrates: the government's line, explained Renzi at the end of the CDM, "is to align with the European model". No therefore to the "Pini model", the honorable Northern League promoter of an amendment that introduced the direct civil liability of magistrates into the Community law in the first reading

4- REFORM OF THE REGULATIONS OF THE SPECIAL JUDGES  

5- RULES AGAINST ECONOMIC CRIME (false financial statements, self-laundering): Among the most relevant points among the 12 mentioned by Renzi, also the priority to the rules against economic crime. The Government, underlined the prime minister, intends to introduce (or reintroduce) new rules on false accounting and self-laundering, "for which the regulatory texts have already been prepared".

6- ACCELERATION OF THE CRIMINAL PROCESS AND REFORM OF THE PRESCRIPTION: Another important novelty is the speeding up of criminal trial times through the reform of the statute of limitations, which "is close to our hearts", Renzi underlined addressing journalists, because "it is a matter of civility. For two months we want to discuss justice in a non-ideological way, it will be a more philosophical, conceptual and abstract discussion before approving the reform to involve Italy on this issue”, added Renzi. 

7- INTERCEPTIONS (right to information and protection of privacy): "The magistrate must be free to intercept, but there must be a limit to the publicity of the interceptions themselves, especially if we are talking about personal facts of the suspects unrelated to the crimes prosecuted ", explained Renzi, who then asked the editors of the newspapers the question: “Is it right that there is no limit? Is there a right to privacy on personal facts?”.

8- Comprehensive computerization of the judicial system: Finally, among the points approved also the complete computerization of the judicial system and the requalification of the administrative staff of the judicial offices.  

9- REDEVELOPMENT of administrative staff.  

10- CIVIL BACKGROUND HAVING: Also ambitious is the goal, always illustrated by the premier, of aiming to halve the backlog of civil trials, now attested at 5 million proceedings. “For separation and consensual divorces it will no longer be necessary to go before a judge”, explained the minister Andrea Orlando
