Ubi: indictment for bank, Messiah, Bazoli, Moltrasio

Indictment for Ubi Banca, for the CEO Victor Massiah, the chairman and vice-chairman of the supervisory board Andrea Moltrasio and Mario Cera, for the former chairman of the management board Franco Polotti, the former chairman of the CDG of Banca Lombarda and Piedmontese Giovanni Bazoli, and 25 other people. The Bergamo prosecutor's office requested it and the bank itself communicated it.

The investigation is the one on the governance of Ubi which hypothesizes for various reasons the crimes of obstructing the supervisory authority and illicit influence on the shareholders' meeting.

In a note, the bank, recalling that the sentence of 19th June of the Brescia Court of Appeal recognized the correctness of UBI Banca and its representatives in relations with the supervisory authorities and with the market, "reaffirms the correctness of its performed and trusts that compliance with the law and organizational rules will be confirmed in all judicial offices”.

The preliminary hearing will be held in Bergamo on November 10th.

The indictment hypotheses of the investigation, coordinated by the prosecutor Fabio Pelosi and the chief prosecutor Walter Mapelli and conducted by the special currency unit of the Gdf of Milan, are that of obstructing the supervisory functions for alleged shareholder agreements in the process that gave rise to Ubi and that of undue influence on the shareholders' meeting for the hypothesis that, on the occasion of the meeting of 20 April 2013 which renewed the offices of the supervisory board, blank proxies were collected, both through the bank's structure and branches and through external structures to ensure the desired grade.
