For the legal battle on Tim, we will have to wait for Monday. On Friday morning the lawyers of the Elliott fund, with a petition, asked to intervene at the hearing before the judge of the Civil Court of Milan Elena Riva Crugnola who must evaluate the emergency appeal filed by the Tim board against the decision of the board of statutory auditors of the company to accept the requests of the US fund to integrate the agenda of the meeting of April 24th.

To represent Elliott is the lawyer Sergio Erede, while for Tim are the lawyers Francesco Gatti and Andrea Zuppini. The six members of the supervisory board of the TLC group, represented by the lawyer Gabriella Chersicla, are in the courtroom.

Tim's board of statutory auditors had accepted Elliott's request to integrate the agenda of the meeting of April 24 with the revocation of six directors from the shareholder Vivendi and the appointment of six other directors.

Telecom's board of directors, with the vote against by the directors appointed by Assogestioni, had declared the mayors' decision illegitimate, announcing the legal appeal in which, together with Vivendi, it asked the Court "for the adoption of urgent measures by the date of 'assembly'.

The duel between the two contenders continued with a mix of communications to the shareholders and a harsh exchange of accusations which is now pending the decision of the Tribunal.

Judge Riva Crugnola, say judicial sources gathered by Reuters, once the documents have been examined and the parties heard at the end of the hearing in closed session, will reserve the decision which will be filed by Monday 23, the eve of the meeting.
