The constitutionalist Francesco Clementi, explains on the site Just a Yes the reasons why some of the reasons put forward by the No front to the constitutional reform are wrong and easily refutable.
Below we offer you the videos through which Clementi, with a few simple words, lists the "10 hoaxes of the No".
1) The election of senators:
Francesco Clementi denies the affirmation of the Hon. Alessandro Di Battista, who defines the new Senate as an "after-worker". False! Other than after work, the role of the Senate changes, which will act as a link between citizens, local authorities and Parliament.
2) Article 70
Journalist Luca Telese argues over the length of article 70. The new article 70 simply specifies what the Chamber and the Senate must do, the length serves to clarify responsibilities.
3) The authoritarian drift
Judge Ferdinando Imposimato argues that the reform gives many powers to the Prime Minister. False! The reform does not change the powers of the executive one iota, and gives the Constitutional Court one more power: that of preventive control of electoral laws.
4) The conjunction
Silvio Berlusconi says that the "combined arrangement" brings a single man to command. False! The conjunction does not exist for two reasons: 1) because the electoral law is subject to the judgment of the Constitutional Court regardless of the referendum; and 2) there is already a debate in Parliament on changing the Italicum.
5) State and Regions
The Hon. Matteo Salvini said that the reform complicates the relationship between the state and the regions. False! The reform does the opposite: it simplifies the State-Regions relationship, assigns merits and responsibilities, and therefore makes life easier for citizens.
6) Parliamentary immunity
Journalist Marco Travaglio confuses parliamentary immunity with impunity: today those who are guilty do not go unpunished. Immunity is a guarantee of separation of powers, without it democracy dies.
7) The costs of the policy
The Hon. Luigi di Maio claims that the reduction in the costs of politics will amount to 50 million euros a year. False! The reduction in direct costs if the Yes vote wins amounts to a good 500 million euros.
8) The European Union
Matteo Salvini argues that the reform introduces the European Union into our Constitution. False! In reality, the EU has already been present in the constitutional text for 15 years and if the No were to win, nothing would change.
9) The hasty Reform
Ciriaco De Mita, like others, claims that this is a hasty reform. False! It actually took more than 2 years of parliamentary work.
10) It could have been done differently
Massimo D'Alema argues that it is possible to create an alternative proposal in a short time in the event of a No victory. False! To carry out a constitutional reform, a long and articulated process governed by art. 138 of the Constitution.
