After the 103,7 million fine recently confirmed by the Council of State, Telecom Italia is once again being targeted by the Antitrust because it would perpetuate 'anti-competitive conduct' in the services provided to other operators in accessing its fixed network. The Authority, according to what emerges from an advance resolution by Radiocor, has in fact opened a proceeding for non-compliance with the warning which required Telecom to refrain from the conduct already sanctioned, precisely with that fine, in 2013.
The procedure was triggered by a new report received by the Authority on 20 January, according to which Telecom Italia would oppose alternative operators with 'an excessively high number of unjustified refusals to requests to activate network access services'. In short, at the center of the procedure there are again those who in the jargon of the sector are called 'technical knockouts'. This time the group risks a fine ranging from double the penalty already received, i.e. 207,4 million euros, up to 10 % of the turnover which is the maximum limit foreseen by law.
