Telecom: the Lazio Regional Administrative Court suspends the 103 million fine for abuse of a dominant position

The Lazio Regional Administrative Court has suspended the 103 million euro fine imposed by the Antitrust on Telecom Italia for abuse of a dominant position – The suspension is linked to the lengthy nature of the Tar proceedings – Wind and Fastweb are appealing.

No fine of 103 million euros, at least for the moment. The fine imposed by the Antitrust on Telecom Italia for abuse of a dominant position – for which proceedings are pending before the Regional Administrative Court – was suspended by the first section of the Lazio Administrative Court. The Tar's decision, at the company's request, was taken in the run-up to the February 8 deadline, when an increase in the fine would have been triggered. The other parties to the dispute have not objected.

The suspension of the enforceability of the fine is linked to the lengthy proceedings before the Lazio Regional Administrative Court due to the acceptance of the preliminary requests. The appellants had in fact requested the acquisition in court of the two integral provisions of the Antitrust, including the omissis. The request then led to postponements of the discussion on the merits.

The Antitrust had fined Telecom last May for abuse of its dominant position in the supply of wholesale access services to the network and broadband. The alternative operators Wind and Fastweb had appealed.

In Piazza Affari, the stock gains 0,77% around 15 pm, to 0,8535 euros.
