According to the Authority, the exclusivity clauses binding taxi drivers in Rome and Milan to the main radio taxi operators have the effect of closing the market - The investigation arose from a report from Mytaxi

Taxi, Antitrust stop radio taxis in Rome and Milan

The exclusivity clauses contained in the deeds governing relations between the main radio taxi operators in Rome and Milan and the taxi drivers violate the rules on competition and must therefore cease. This was established by the Competition and Market Authority.

Indeed, according to the Antitrust, the aforementioned clauses between radio taxi operators active in Rome (Radiotaxi 3570 – Cooperative Society, Cooperative Pronto Taxi 6645 – Cooperative Society, Samarcanda – Cooperative Society) and Milan (Taxiblu Consorzio Radiotaxi Satellitare Cooperative Society, Yellow Tax Multiservice Srl and Autoradiotassì Società Cooperativa) and the adhering taxi drivers, "to the extent that they bind each taxi driver to allocate all of their operational capacity, in terms of journeys per shift, to a single radio taxi, constitute networks of vertical agreements restricting competition in violation of the Article 101 of the TFEU".

In fact, the Antitrust considered that the imposed clauses determine a "closing effect of the collection market and misdirection of the demand for the taxi service in Rome and Milan, hindering access to new operators who adopt a different and innovative model of business”. Among these is Mytaxi, a company belonging to the Daimler group which manages an open platform through aapp freely accessible by affiliated taxi drivers, from whose reporting the Authority's investigation was born.

Due to the reasons listed above, the Antitrust - while not providing for any sanctions - has established the termination of any clause that represents a restriction on competition and has imposed radio taxi companies "to notify the Authority, within 120 days of notification of the measure, of the initiatives they intend to put in place to eliminate the infringement ascertained".
