If the garbage collection service isn't working as it should, taxpayers can ask a discount on the Tari of up to 80 percent of the amount due. Not everyone knows this, because it is a right that administrations have no interest in publicizing. Nevertheless the 2014 stability law speak clearly:

«The Tari is due up to a maximum of 20 percent of the rate – as stated in paragraph 656 of article 1 – in the event of failure to perform the waste management service, or if it is carried out in serious violation of the reference regulations, as well as interruption of the service for trade union reasons or for unforeseeable organizational impediments which have resulted in a situation recognized by the health authority as damage or danger of damage to people or the environment".

In other words, the municipalities must guarantee an 80% discount to citizens if they can prove that one of the following circumstances has occurred:

1) the waste collection service it was not done;
2) the waste collection service it was done incorrectly (for example by violating the regulations on waste separation) or incomplete (when collection is irregular), also due to strikes or other organizational difficulties, provided that the disservice has damaged or endangered the environment or human health, a circumstance that must be recognized by the ASL or by another health authority.

You don't need to demonstrate that you have personally suffered damage: as confirmed by a recent ruling by the Provincial Tax Commission of Vibo Valentia (n. 931/2/2016) it is sufficient document the blockage or irregularity of the service, for example with photographs.

The same sentence establishes that the 80 percent discount on the Tari is due even if the Municipality has published an ordinance to oblige the waste collection management company to continue the service. Furthermore, it is not necessary for the health authority to have adopted a formal provision to certify the danger or damage to the environment or people: it is sufficient that it has reported the risk in any way.

But it's not over. Let's go back to the 2014 maneuver and read the paragraph following the previous one:

"In areas where collection is not carried out, the Tari is due in an amount not exceeding 40 per cent the tariff to be determined, even gradually, in relation to the distance from the closest collection point falling within the perimeter area or actually served".

Translation: the discount on the Tari is at least 60 percent in areas where the collection service is not provided and the rate itself is the lower the farther away is the place where you have to go to throw the garbage.
