Viareggio massacre: Moretti sentenced to 7 years on appeal

Sentence against the former CEO of Rfi and Fs confirmed for the Viareggio train disaster – Michele Mario Elia, former CEO of Rfi, and Vicenzo Soprano, former CEO of Trenitalia, are sentenced to 6 years. The statute of limitations for fire crimes and multiple culpable injuries has been triggered.

Viareggio massacre: Moretti sentenced to 7 years on appeal

Mauro Moretti sentenced to 7 years in the context of the trial for the Viareggio massacre in which 32 people lost their lives due to the derailment - on 29 June 2009 - of the Trecate-Gricignano freight train, consisting of 14 tank wagons containing LPG. This is the decision of the Court of Appeal of Florence which therefore confirms the sentence of first instance. The Attorney General had asked for 15 years and 6 months.

Moretti, who was absent from the courtroom, was declared guilty not only as a former managing director of Rfi, but also as a former CEO of FS. He was charged with disaster, manslaughter, manslaughter, arson. On February 11, the manager said at the hearing to waive the limitation period, but the pg subsequently clarified that since May 2018 the limitation period has been triggered for fire and culpable injuries.

Confirmed the convictions also against Michael Mario Elias, former CEO of RFI, and Vincenzo Soprano, former CEO of Trenitalia, received a six-year sentence. They were accused, for various reasons, of multiple manslaughter and train wreck.

Sentence to 8 years and 8 months for Rainer Kogelheid, CEO of Gatx Rail Germany, manager of the company that had leased the tank wagons to Ferrovie dello Stato. 7 years and 3 months to Joachim Lehmann, who was acquitted in the first instance, supervisor at the Jugenthal Workshop in Hanover.

Instead, four RFI employees were acquitted: Giovanni Costa, Giorgio Di Marco, Giulio Margarita and Enzo Marzilli, who in the first instance had been sentenced to between six and six and a half years.

Finally, the court of appeal confirmed the sentence against Trenitalia and Rfi to pay 700.000 euros for administrative liability (pursuant to Law 231/2001), but canceled the company disqualifications established by the court. Fs spa, FsLogistica and Cima Riparazioni spa remain acquitted as in the first instance.
