First parliamentary go-ahead for the new ways of submitting resignations from the employment relationship. The Assembly of the Chamber approved the bill, which will now have to go to the Senate, aimed at establishing the obligation to use special pre-numbered forms as a condition for the validity of the resignations presented by the worker to his employer.

The innovation was born out of the need to prevent the phenomenon of so-called "blank resignations", demanded by the employer upon hiring as an improper form of termination, at any time and at will, of the employment contract. At the time of hiring, in fact, the employer is able to exert any pressure to obtain an undated signed letter of resignation, which he can use later when he wants to terminate the employment relationship, without respecting the constraints set by the employment contracts. work and by law. According to information from trade union sources, employers resort to this device especially for women, to protect themselves from the possibility of maternity.

The solution to the problem, foreseen by the bill approved by the Chamber, consists in imposing the obligation to formulate the resignation on special pre-printed forms, distributed by the employment offices, which will be pre-printed and pre-numbered. The worker who wishes to resign voluntarily must necessarily use, under penalty of nullity of the resignation, one of these special forms, which, as pre-numbered and preceded, can only have been signed at the time of the actual resignation, and not at the time of hiring.

The new regulations would apply to all forms of subordinate employment relationships, regardless of their characteristics and duration, and also for coordinated and continuous collaboration agreements, including project agreements, occasional employment agreements, partnership agreements and for those established by cooperatives with their own members. The special forms for resignation must be made available free of charge by the local labor directorates, by the municipal offices and by the employment centres, also through the websites. They will report a progressive alphanumeric identification code, the date of issue, as well as the spaces to be filled in by the resigning worker. They will be valid for fifteen days from the date of issue.

The bill, now awaiting examination by the Senate, stems from two legislative initiatives advanced by Nichi Vendola (SEL) and Teresa Bellanova (PD), currently also undersecretary at the Ministry of Labor and Social Policies. It was examined by the assembly in the ambit of the spaces granted to the minority parliamentary forces, due to the political agreements reached in the planning of the Montecitorio works. It was approved with the favorable opinion of the Government.
