An extensive appeal to the Lombardy Regional Administrative Court was notified yesterday for the annulment of the Giunta's resolution on the Meazza stadium.

The appeal - which due to its complexity goes far beyond the protection of the neighborhood alone - was presented by 67 citizens of Milan, residents and non-residents in the San Siro area, with the support of the San Siro Coordination Committee and the SiMeazza Committee.

It thundered so much that it rained.

The Milanese citizens and committees, after having repeatedly tried to find a path of dialogue with the public administration regarding the so-called "new stadium project" at San Siro without receiving any type of response, took legal action with the one representing the first and most urgent move, to be followed by others.

The Mayor of Milan, the Ministry of Culture in the person of the pro tempore Minister Dario Franceschini, the Regional Secretariat of the Ministry of Cultural Heritage and Activities for Lombardy, Milan ACSpA and Internazionale FCSpA are called into question

"Our appeal considers the San Siro question certainly not a local question, but a citizen, metropolitan and national one: hence also the fact that many non-resident citizens in the San Siro area have signed" said Luigi Corbani, president of the SiMeazza Committee who collected over 1500 adherents in a few weeks.

It is a very articulated appeal – drawn up by the lawyers Veronica Dini, Roberta Bertolani and Felice Besostri – which contemplates both formal and substantive issues.

"Since the proposing companies hypothesized the new stadium project in mid-2019, we have repeatedly asked for alternative solutions to be considered to monster overbuilding on an area of ​​deep green which is instead so important in the ongoing climate emergency. passing through the protection of an existing and functional stadium that only needs modernization” they say from the San Siro Coordination Committee. "Unfortunately our requests have never been answered, except for that of the mayor Sala who declared that he wanted to decide on his own and that he was unable to convince the teams, as if they were the only ones interested and not the citizens".

The Dini-Bertolani-Besostri appeal deals with many issues.

On the procedural side, for example, the lack of detailed reasons on the part of the proponents of the restructuring hypothesis of the Meazza is underlined on the one hand, and the Superintendence's lack of involvement on the other.

But the issues of unconstitutionality of the law on stadiums and the non-declaration of the beneficial owner of the building are also raised.

Then there are many issues of a substantial nature ranging from an unmotivated public interest in detail, to environmental impact and financial reliability.

“With the "new stadium" proposal and related buildings, the community, understood as a metropolitan area as well as a city, will lose out, both from an environmental and an economic point of view. About the public interest." comments the lawyer Veronica Dini who recalls how, with the Petition to the European Commission forwarded and accepted by Brussels last year, the issue has also gone beyond national borders.

“In fact, the procedure that led to the declaration of public interest seems to have been constructed for the sole purpose of satisfying the – private – interest of the companies, in spite of the sector regulations and the opinions themselves issued by the competent offices. Suffice it to say that there is not even a line in which the Municipality explains what the public interest of the project proposal loaned by Inter and Milan would consist of” continued Dini.

"The Dini-Bertolani-Besostri lawyers have provided substantial legal reasons in support of the non-existence and/or unconstitutionality of the rules invoked in support of the deliberation of the Giunta, made with superficiality and haste despite the long response times of the two companies to the objections of the offices municipal authorities, contained in the preliminary investigation reports of the resolutions and an integral part of the same resolutions” adds Corbani.

The appeal was notified on January 3 and will be registered in the next few days.

Requests the annulment of the Resolution of the City Council of Milan n. 1379 of 5/11/2021, having as «SUBJECT: Proposal referred to in article 1, paragraph 304, letter a), of the law of 27 December 2013, n. 147, as amended by art. 62 of the decree-law of 24 April 2017, n. 50 coordinated with the conversion law 21 June 2017 n. 96, relating to the "Stadio di Milano" received on 10 July 2019 already declared - with conditions and provisions - of public interest with resolution GC 08/11/2019 n. 1905. Confirmation of the declaration of public interest - with conditions - in relation to the contents of the project documents submitted on 6 November 2020» for the cancellation of all the presupposed, connected and consequent deeds, including the City Council Resolution n. 1905 of 8.11.2019.
