Smart working extended until 31 December for fragile workers and parents of under 14s: here are the latest news

Extended until December 31, 2022 lo smart working for fragile workers and parents of children under 14, which they will also be able to take advantage of simplified procedure for the confirmation communication: it is sufficient to provide the Ministry electronically with the fundamental data on the general information and the duration of the period of smart working. Even private sector workers, at least until the beginning of next year, will be able to activate smart working without the need to sign individual agreements.

The measure finds space in the conversion law of Dl Aid bis approved by the Senate last Thursday 15 September. But let's see in detail who they are fragile and workers with children under 14 which they can use smart working up to 31 December 2022.

Smart working fragile workers: who they are and how it works

I fragile workers, i.e. public and private employees with severe disabilities, (in possession of certification attesting to a condition of risk deriving from immunosuppression or from the outcomes of oncological pathologies or from carrying out the relative life-saving therapies) will be entitled to lend remote work activity, also by providing for a different job included in the same category or area of ​​classification, as defined by the collective agreements in force, or professional training courses.

Even the workers mostly exposed to the risk of contagion (deriving from age, immunosuppression, oncological pathologies, carrying out life-saving therapies, comorbidities) based on the assessment of the competent doctor in the context of the surveillance referred to in article 83, paragraph 1, of the relaunch decree, they will be able to work in agile mode without individual agreements.

Simplified smart working also for workers with children under 14

As regards the workers with at least one child under the age of 14 the right to simplified smart working, even in the absence of individual agreements with the employer, it is recognized again provided that it is compatible with the characteristics of the service and that there is no parent in the family unit or that it receives one or more social shock absorbers, such as the cash register integration.
