Paid bio bags, that's how they were born

Italy is currently the only country to have transposed the European directive. The decree containing the decision to "reduce the use of lightweight plastic bags" contains dozens of provisions of various kinds, from University regulations to provisions for the conduct of the school year: an absurd and botched way of legislating .

Paid organic bags, the controversies do not subside, indeed they seem to get worse. Whose idea was it to charge them? Is it an EU tax? No, it's one autonomous decision of our government. It is true that everything stems from a Community directive, but it must be remembered that if on the one hand a directive is a legislative act which
sets a goal that all EU countries must achieve, on the other hand, however, it is up to individual countries to define through national provisions how these goals are to be achieved

And the EU directive 2015/720 from which everything is born indicates the progressive reduction of the use of plastic bags, without going into the merits of "how" to achieve this goal. Well, the law took care of it for us 123/2017 which is the conversion into law of decree n.91 of 20 June last year concerning "Urgent provisions for the growth of the South".

And what do bio-bags have to do with the South? Nothing. But that decree is one of the many examples of how we used to cram a provision with everything and more. In this same law converting that decree there are, for example, rules on the University, on access to the pension treatment of
workers employed in companies that use asbestos (art.13, ter), on the Istat sanctions for municipalities with smaller demographic dimensions (art.15, ter), on the contribution to the provinces and metropolitan cities (art.15, quinues), provisions for the 2017/2018 school year (art. 25, octies), the establishment of the table for the reorganization of the regulation of interregional automotive services under state competence (art. 16 quinquis) and also (art. 16 novies) provisions for the celebrations in honor of Antonio Grasci
(with a contribution of 350 thousand euros for the year 2017).

Ed here we are at article 9-bis implementing directive (EU) 2015/720 of the European Parliament and of the Council of 29 April 2015, as regards the reduction of the use of plastic bags made of lightweight material. Well, paragraph 5 establishes that "Plastic bags made of ultra-light material cannot be distributed free of charge and to this end the sale price for each unit must be shown on the receipt or purchase invoice of the goods or products packaged for the through them".

It is an all-our initiative, currently unique in Europe. Will we lead the way, or will the controversies that have arisen lead to a reverse? As for the ban on using bags other than those put on
available in the departments of the point of sale, it is an adaptation of the Ministry of the Environment to a European regulation. And unlike a directive, a regulation is a binding piece of legislation. It must be applied in its entirety throughout the European Union.
