On Wednesday, April 12, 2023, an agreement was reached between Confcommercio - Companies for Italy, represented by the Vice-President, Donatella Prampolini, and Manageritalia, in the person of the President Mario Mantovani, for the renewal of the National Collective Agreement for Managers of the companies of the tertiary, distribution and services.

The renewal agreement, effective from 1 January 2022 and valid until 31 December 2025, concerns over 27 thousand managers and 9 thousand tertiary companies in key sectors of the national economy such as: commerce, modern distribution, business services, digital, fashion and luxury, automotive, fairs, tourism, non-profit.

According to the signatory parties, it is a "balanced agreement which will allow, at least in part, managers to recover from the surge in inflation that has occurred in the last period without excessively burdening businesses".

In fact, the contract renewal has a purely economic value, awaiting the interventions already implemented on corporate legislation and welfare with the agreement to extend the CCNL signed on 16 June 2021.

Contract renewal for Tertiary Executives: what it provides

Lump sum

The disbursement of an amount in 2023 One-off payment of 2.000 euros as cover for the 2020-2022 vacatio period, to be paid in three installments, by way of salary arrears. The amount is due to the executives in force on the date of signing of the agreement, including those appointed in the same period, according to the following timing:

  • 700 euros in May 2023
  • 700 euros in September 2023
  • 600 euros in November 2023

Furthermore, executives hired in the period 1 January 2020-31 December 2022 and in force as at 12 April 2023 are entitled to the Una Tantum pro rata based on the months of length of service accrued in the position in the aforesaid period.

The Una Tantum, as per current labor legislation, has no effect on the calculation of the severance pay and does not affect any other contractual institution.

In the event of termination of the employment relationship before the payment of one or more one-off installments, the residual amount must be paid together with severance pay.

Salary increases

The following are expected monthly contract increases:

  • 150 euros from 1 December 2023
  • 150 euros from 1 July 2024
  • 150 euros from 1 July 2025.

If necessary, the increases may be absorbed, up to the amount, by the amounts disbursed by the companies after 31 December 2019 if granted as an advance or advance of future contractual increases.  

Contract minimums

For executives hired or appointed as from 1 December 2023, the contractual minimum is set at 4040 euros, 4.190 euros from 1 July 2024 and 4.340 euros from 1 July 2025.

The amounts of contractual minimums fixed in this way, they obviously include the increases due to executives in force as at 30 November 2023 on the same dates.

Corporate welfare

On an experimental basis for the two-year period 2024-2025, companies will allocate to the Platform welfare managers tertiary an individual credit of 1.000 euros per year, which can be spent on welfare goods and services, with effect from 1 January 2024 and 1 January 2025, in addition to any flexible benefits systems already present in the company.

The innovation of the Platform, which integrates contractual and corporate welfare and also allows small companies with a single manager to take advantage of services dedicated to managers, is therefore completed with the allocation of a sum, which can actually be spent starting from 2024, to increase the level of welfare in a personalized way.

Mario Negri Fund

Finally, the supplementary contribution payable by the employer al Background of supplementary pensions Mario Negri, including the contractual membership fee, increased from 2,39% to 2,43% from 1 January 2024 and to 2,47% from 1 January 2025.
