How eager is the government to put environmental issues on the agenda? The topics are inextricably linked to other economic processes that cross the country. But political actions are more often than not very effective. The circular economy, which is talked about on an infinite number of occasions, has urged the Antitrust to intervene on the Consolidated Environmental Text especially on waste. Does an Italian industrialist have the right to deliver his company's waste to a company other than the urban disposal company? Yes, there is no obligation. Companies can confer "in whole or in part" their waste, says the Competition and Market Authority. The government must prepare the new law on competition and the Authority in view of the provision has clarified that the waste produced by economic activities can have a different treatment from that of households. The cornerstones of a circular economy today they are subjected to municipal management systems that can compromise their effectiveness. The Italian Municipalities continue to flounder in the sector waste. However, every effort must be made to implement a green strategy that seems caged in municipal management. The company that chooses to leave the municipal obligation will also have to derive an economic advantage. The municipal tariff will therefore be variable for those who choose autonomous managers. This applies a principle of proportionality and of competition in relation to what is handed over to be treated differently. Better yet, recycled.

The environment is no longer a political option

The Antitrust had contested a decision by the Municipality of Castelvetrano in Sicily on the same subject. To get an idea of ​​the dispute, even Arera had established that non-domestic users can deliver urban waste outside the public service. "Every time in which in the territory in which non-domestic users operate there were no active industrial subjects to whom to confer all the fractions of waste similar to the urban product, they would be forced to join the public service", writes the Competition Authority . The point is precisely this: because a mayor must limit the freedom of an entrepreneur which, after all, favors the recovery of waste? If there are private operators with whom the company can enter into contracts, this must be ensured. The sector currently most exposed is that of packaging that must be recovered. But the Antitrust has not missed the opportunity to report critical issues also for the other services entrusted by the Municipalities. The environmental ones are the most substantial and at risk of legality. Now calls are being made for the reintroduction of the outsourcing obligation for i works under concession without tendering to enterprises owned or controlled by the public sector. Changing the Consolidated Environmental Text is the clearest action that the center-right can take in the coming weeks. It would be understood as a signal of enrichment of the political agenda. The premier Giorgia Meloni and the Ministers concerned should not let the opportunity slip away.
