Unipolsai, Generali e Allianz end up in the crosshairs ofAntitrust "for alleged unfair commercial practices in the phase of settlement of damages from motor liability claims”. She writes it in a note the Competition and Market Authority, specifying that it had launched three investigations into the insurance companies involved.

In detail, Unipolsai, Generali and Allianz "have carried out an aggressive commercial practice - continues the Antitrust - hindering the right of injured consumers to access the claims file documents through dilatory, obstructive behavior or unjustified denial of the requests presented".

In this way, according to the Authority, the three companies "would not have allowed the holders of the right to compensation to know the method of managing their request and the criteria for quantifying the proposed amount".

Furthermore, Generali and Allianz would have hindered "the exercise of the rights deriving from the motor liability insurance contract - continues the Antitrust note - requesting documentation deemed necessary for the liquidation of the damage even though it had already been sent to the liquidator of the company or was already available e violating the times established by law for the completion of the liquidation procedure".

Finally, the Authority believes that Unipolsai and Generali have failed to indicate “the criteria for quantifying the damage in the phase of formulation of the compensation offer or the reasons underlying the refusal of the compensation itself. A conduct which, if verified, would not allow the damaged parties to decide whether to accept the company's proposal or reject it".

On 26 November the Authority, in collaboration with the Special Antitrust Unit of the Guardia di Finanza, conducted a series of inspections at the offices of the three insurance companies.
