The tax decree approved in the Budget Committee in the Chamber (and now being examined by the House) aggravates the Italian insurance paradox. In our country, anyone who lives alone, has a car and buys a scooter, cannot insure the two-wheeled vehicle with the same class of merit as the car, even though it is the same person driving both vehicles. For those who live with the family, however, things are simpler. Thanks to the Bersani law of 2007, children (of any age) can insure each new vehicle that enters the family nucleus with the most favorable class of merit among those of the parents. The rule that has been in force for 12 years has two limits: to benefit from the discount, the vehicle must have just been purchased (whether new or used) and it must be of the same category as the vehicle whose class of merit it will follow ( therefore cars with cars, scooters with scooters).

Here, the tax decree cancels these two limits: vehicles that have not just been purchased and those of different categories will also be eligible. Translation: a child who has had a scooter for several years and has caused several accidents will be able to insure that same scooter in first class, benefiting from the years of accident-free driving of one of his parents. Then, if he continues to cause accidents, he will go down in class, but he will immediately be able to enjoy a significant benefit.

The paradox lies precisely here: those who live alone cannot transfer their insurance class from a car to a scooter, while those who live with a family can do so, and moreover by exploiting the class of merit of a parent, who perhaps has a driving style much safer than his.

Let us now recap the latest innovations introduced in the tax decree.

PRISON AND MEASURES AGAINST ESCAPE

  • For the fraudulent declaration the maximum penalty rises from 6 to 8 years.
  • For the less serious crimes of omitted declaration and unfaithful declaration – not fraudulent, i.e. committed without the intention of defrauding the tax authorities – the increase in prison sentences is reduced.
  • As for the non-payment of withholding taxes and VAT, the current thresholds of punishment remain unchanged (150 and 200 thousand euros respectively).
  • Confiscation due to disproportion on assets that cannot be justified on the basis of declared income is limited to the most serious cases. Up to now it was mainly used against the mafia. It is also applicable preventively.  
  • The extension of legislative decree 231 on the liability of directors to tax crimes remains, which has met with strong opposition from Confindustria. which speaks of a “hyper-repressive approach”. The fines could reach one million euros. There is also the possibility of preventive interdiction of relations with the public administration
  • Only on orders exceeding 200 thousand euros, the client is required to pay all withholding taxes made by the contractor or contractor and by subcontractors without recourse to compensation.

"We contest the government's repressive approach and a series of interventions that criminalize businesses: the approval of the tax decree is a confirmation", comments Marcella Panucci, general manager of Confindustria, in an interview with Corriere della Sera. "I believe that the problem of evasion cannot be solved by doubling the amount of penalties, but rather by encouraging virtuous conduct".

MODEL 730 EXPIRY

The deadline for submitting the 730 is moved from 23 July to 30 September. Furthermore, the possibility of using the 730 model is also extended to those who receive income assimilated to that of employment and income from self-employment or occasional work.

POS

The sanctions for traders who do not have a POS have been lifted. In any case, the introduction of a single electronic receipt for card payments is envisaged in two years: from 2021, POS can be used as a single instrument for electronic payments and in cash and for the certification of electronic receipts.

ANTI-ABANDONMENT SEATS

The fines for those who do not install anti-abandonment seats in the car will only start from 6 March 2020.

TAX BUFFER

VAT on biodegradable sanitary towels for women drops from 22 to 5%.

PAYMENTS VIA SMARTPHONE

The 30% tax credit on card payment fees will also be extended to smartphone transactions.

RECEIPT LOTTERY

The entry into force of the receipt lottery has been postponed from January XNUMXst to July XNUMXst.
