Fidia (Italian Federation of Insurance Company Executives) was set up in recent days civil party in the Turin trial on Fondiaria-Sai. The Court of Turin established it on 30 January, recognizing Fidia's legitimacy to intervene as a civil party in the proceedings, on a par with all the consumer associations and most of the small shareholders (over 3.500) who have intervened so far. It is the first time that a trade union has filed a civil action in this case.
"For Fidia - declared the Chairman, Claudia Anselmi - this is a result of considerable importance and of great satisfaction, because the Court's decision recognizes the thesis according to which the alleged conduct harms the interests protected by the Trade Union Body, i.e. the prestige and honor of the insurance executives represented by the Federation I preside over”.
Fidia, founding member of Cida (Manager and High Professionalism for Italy), is the only trade union organization present at the Turin process. Disregarding the specific objection raised by the defense of the defendants, the Court of Turin therefore expressly considered the trade union entitled to claim against the latter and in the event of ascertained criminal liability, the existence of unjust damage of a non-pecuniary nature, caused with the conduct alleged against all executives of insurance companies and in particular Fidia members.
“The absence of a tangible and direct economic prejudice – said the lawyer Roberto Brizio- therefore did not prevent us from acknowledging the existence of a damage deriving from false company communications and information rigging. For this reason, the fact of intervening as a civil party in the Judgment must be considered a great success of Phidias".
